Amends the Criminal Code of 1961. Makes a technical change in a Section concerning presumption of innocence and proof of guilt.

Deletes everything. Amends the Computer Crime Article of the Criminal Code of 1961. Deletes existing provisions concerning the transmission of unsolicited bulk electronic mail, and provides that a person commits the offense of transmission of unsolicited bulk electronic mail when he or she: knowingly uses a computer or computer network with the intent to falsify or forge electronic mail transmission information or other routing information in any manner in connection with the transmission of unsolicited bulk electronic mail through or into the computer network of an electronic mail service provider or its subscribers; or knowingly sells, gives, or otherwise distributes or possesses with the intent to sell, give, or distribute software that: (i) is primarily designed or produced for the purpose of facilitating or enabling the falsification of electronic mail transmission information or other routing information; (ii) has only limited commercially significant purpose or use other than to facilitate or enable the falsification of electronic mail transmission information or other routing information; or (iii) is marketed by that person acting alone or with another for use in facilitating or enabling the falsification of electronic mail transmission information or other routing information. Provides that a violation is a Class A misdemeanor (or a Class 4 felony if the volume of unsolicited bulk electronic mail exceeds specified amounts, the revenue generated from unsolicited bulk electronic mail exceeds specified amounts, or an adult knowingly hires, employs, uses, or permits a minor to assist in the violation). Provides for recovery of specified damages in a civil action by a person whose property or person is injured by reason of a violation. Provides that the court may conduct proceedings so as to protect the secrecy and security of the computer, computer network, computer data, computer program and computer software involved, to prevent possible recurrence of the same or a similar act by another person, and to protect trade secrets and the privacy of nonparties. Provides for property forfeitures under specified circumstances against a person who commits the offense. Makes other changes. Amends the Code of Civil Procedure. Provides that the use of a computer or computer network located in this State by a person thereby submits the person to the jurisdiction of the courts of this State as to any cause of action arising from that use.
