Replaces everything after the enacting clause. Amends the Illinois Clinical Laboratory and Blood Bank Act. Adds definitions for "health care operations", "HIPAA", "payment", and "treatment". Makes changes concerning the reporting and transmitting of clinical laboratory test results. Amends the AIDS Confidentiality Act and the Genetic Information Privacy Act. Makes changes concerning findings, definitions, and disclosure of information under the Acts. Adds provisions concerning uses and disclosures of information: for treatment, payment, and health care operations; for health oversight activities; for public safety activities; to business associates; and to a health information exchange. Adds provisions concerning health information exchange opt out and research. Provides that, when using and disclosing information under the Acts, the disclosure shall be in accordance with the minimum necessary standard under HIPAA. Makes other changes. Amends the Unified Code of Corrections to change cross-references to provisions of the AIDS Confidentiality Act made necessary by the amendatory Act.

Further amends the AIDS Confidentiality Act and the Genetic Information Privacy Act. With regard to the definition of "health information exchange" or "HIE" to mean a health information exchange or health information organization that oversees and governs the electronic exchange of health information that, as of August 16, 2013, was designated by the Authority Board as a member of, or was represented on, the Authority Board's Regional Health Information Exchange Workgroup, includes the condition: provided that such designation shall not require the establishment of a data sharing arrangement or other participation with the Illinois Health Information Exchange or the payment of any fee. Further amends the Genetic Information Privacy Act to provide that when using or disclosing genetic-related information under the Act, a covered entity shall do so in accordance with the minimum necessary standard under the Health Insurance Portability and Accountability Act of 1996.

Amends the Illinois Health Information Exchange and Technology Act. Provides that any health care provider who relies in good faith upon any information provided through the Illinois Health Information Exchange (ILHIE) in his, her, or its treatment of a patient shall be immune from criminal or civil liability or professional discipline (rather than only criminal or civil liability) arising from any damages caused by such good faith reliance. Amends the Medical Patient Rights Act. Permits a patient to waive his or her right to privacy and confidentiality in health care through the patient's legal representative. Provides that in the interest of public health, safety, and welfare, patient information, including, but not limited to, health information, demographic information, and information about the services provided to patients, may be transmitted to or through a health information exchange and requires that patients be provided the opportunity to opt out of their health information being transmitted to or through a health information exchange. Further amends the AIDS Confidentiality Act. Makes changes to the definition of "informed consent". Amends the Code of Civil Procedure. With regard to the prohibition against a physician or surgeon being permitted to disclose any information he or she may have acquired in attending any patient in a professional character, includes in the exceptions disclosure to or through a health information exchange in accordance with State or federal law. Adds references of "health care professional" to those of "health care provider". Makes other changes.
