Synopsis As Introduced
Amends the Environmental Protection Act. Provides that if the Environmental Protection Agency has formed a priority list for payment out of the Underground Storage Tank Fund, an owner or operator on the priority list may assign to a person that is in the business of receiving assignments of payments from the Fund the full approved payment amount on the list for which the owner or operator is awaiting payment. Provides that the Agency shall prescribe forms for such an assignment. Provides specific limitations on the assignment. Effective immediately.

 Fiscal Note (Illinois Environmental Protection Agency)
 HB 277 would not impose any additional costs on the Agency or the State. Because the amount of the reimbursement would not be affected in any way by this bill, the bill is revenue neutral.

Senate Floor Amendment No. 2
Deletes everything after the enacting clause. Amends the Environmental Protection Act. Provides that if the Environmental Protection Agency has formed a priority list for payment after completion of underground storage tank corrective action measures, an owner or operator on the priority list may assign to any bank, financial institution, lender, or other person that provides factoring or financing to an owner or operator or to a consultant of an owner or operator a full approved payment amount on the priority list for which the owner or operator is awaiting payment. Provides that the making of an assignment shall not affect an owner's or operator's right to appeal an Agency decision and no assignee shall have a right to appeal an Agency decision regarding an assignment. Provides that an owner's or operator's assignment is irrevocable and may be made to only one assignee. Provides that the State shall pay the assigned amount, subject to the off-set rights of the State Comptroller, to the one assignee only and that the State is discharged of all liability upon payment of the assigned amount to the assignee. Effective immediately.
