Synopsis As Introduced
Amends the Criminal Code of 1961. Provides that criminal sexual assault also occurs when a person commits an act of sexual penetration with a victim who is under 19 years of age and is still attending high school when the act was committed and the accused was 17 years of age or older and held a position of trust, authority, or supervision at the same high school. Provides that a violation is a Class 1 felony for a first offense and a Class X felony for a second or subsequent offense.

Deletes everything after the enacting clause. Amends the Criminal Code of 1961. Provides that the accused commits criminal sexual abuse if he or she commits an act of sexual conduct with a victim who is at least 18 years of age and under 21 years of age when the act was committed and who is a student attending classes at a public or private secondary school and the accused held a position of trust, authority, or supervision in relation to the victim at the same school. Provides that a violation is a Class 4 felony. Provides that the accused commits aggravated criminal sexual abuse if he or she commits an act of sexual penetration with a victim who is at least 18 years of age and under 21 years of age when the act was committed and who is a student attending classes at a public or private secondary school and the accused held a position of trust, authority, or supervision in relation to the victim at the same school. Provides that a violation is a Class 2 felony.

House Floor Amendment No. 2
Provides that the maximum age of the victim of these offenses is under 20 years of age instead of under 21 years of age.
