Synopsis As Introduced
Amends the Attorney Act. Provides that a person engaging in the unauthorized practice of law is subject to a court order that includes, but which is not limited to: equitable relief; a civil penalty not to exceed $5,000; actual damages; attorney's fees and costs attributable to the action in which the order was entered; punitive damages if the conduct was wilful, intentional, or done with a reckless disregard for the rights of others; and other relief necessary to remedy the person's wrongdoing (at present, the prohibited conduct is to be "punished accordingly"). Provides that the civil penalties collected shall be paid to the Illinois Equal Justice Foundation.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause with substantially similar provisions, except for the following: provides that a person engaging in the unauthorized practice of law is subject to a court order that includes, but which is not limited to: equitable relief; a civil penalty not to exceed $5,000, payable to the Illinois Equal Justice Foundation; and actual damages.

Creates the Supreme Court Historic Preservation Act. Provides for the Supreme Court Historic Preservation Commission to assist and advise the Supreme Court concerning the acquisition and preservation of historic buildings, objects, and documents related to the Illinois judiciary. Sets forth provisions for the appointment and operation of the Commission. Creates the Supreme Court Historic Preservation Fund as a special fund in the State treasury. Provides that moneys in the Fund may be used, subject to appropriation, by the Commission for historic preservation and related purposes. Requires the State Treasurer to transfer $5,000,000 to the Fund from the General Revenue Fund. Requires annual reports by the Commission. Amends the State Finance Act. Creates the Supreme Court Historic Preservation Fund. Exempts the Supreme Court Historic Preservation Fund from the Act's administrative charge-back provisions. Adds an immediate effective date.
