Synopsis As Introduced
Amends the Illinois Highway Code. Makes a technical change in a Section concerning the short title.

House Floor Amendment No. 2
Deletes reference to:
605 ILCS 5/1-101from Ch. 121, par. 1-101
Adds reference to:
605 ILCS 10/32.1 new

Replaces everything after the enacting clause. Amends the Toll Highway Act. Provides that the Toll Highway Authority may exercise any powers it has under the Toll Highway Act on the effective date of the amendatory Act to construct new railroad tracks. Provides that the Authority may charge an access fee to any passenger or freight rail operator who wishes to use tracks which the Authority has constructed using powers granted under the amendatory Act. Provides that moneys in the Road Fund may not be used to implement the new provisions. Effective immediately.

Governor Amendatory Veto Message
Recommends that the Toll Highway Authority be required to obtain written approval by the Governor to "design and construct" (instead of "construct") new railroad tracks, and that authorization must be granted to the Authority for each individual and distinct railroad track project.
