Synopsis As Introduced
Creates the Prisoner Census Adjustment Act. For purposes of creating election districts and redistricting, requires that State and local governmental bodies use census figures adjusted to reflect the pre-incarceration addresses of persons imprisoned in State or federal facilities in Illinois. Requires the Secretary of State to make the adjustments based upon information reported by State and local governmental entities that operate or place persons in facilities. Imposes the requirements beginning after the next federal decennial census.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Reinserts the provisions of the introduced bill with changes. Provides that the Secretary of State shall prepare and disseminate adjusted population counts no later than the next August 1 (instead of September 1) following the date on which the tract-level population counts for the State are released by the director of the Bureau of the Census. Provides that reports by State and local governmental entities that operate facilities for incarcerated persons must be submitted no later than May 1 (instead of June 1) of the year in which the census is conducted. Provides that districts, wards, and precincts must be redistricted according to the adjusted population counts (the introduced bill provides that the district, ward, or precinct must not vary from the adjusted count by more than 5%). Effective January 1, 2020.

House Floor Amendment No. 2
In a Section requiring State and local governmental entities to submit certain data regarding incarcerated persons who responded to a census inquiry, provides that those State and local governmental entities are required to include only incarcerated persons who have less than 4 years remaining on their sentences on the date for which the census reports population. Provides that census figures shall be adjusted only for incarcerated persons with less than 4 years remaining on their sentences and for whom a previous address is reported.

House Floor Amendment No. 3
Provides that the Secretary of State shall prepare and disseminate adjusted population counts no later than 30 days after publication of census redistricting data for this State by the United States Census Bureau (instead of by August 1 following the date on which the tract-level population counts for this State from the federal decennial census are released by the director of the Bureau of the Census of the United States Department of Commerce).
