Synopsis As Introduced
Amends the Illinois Marriage and Dissolution of Marriage Act. In provisions concerning the dissipation of marital or non-marital property, provides that a party's claim of dissipation is subject to the following conditions: a notice of intent to claim dissipation shall be given no later than 60 days before trial or 30 days after discovery closes, whichever is later; the notice shall contain, at a minimum, the time period during which the marriage began undergoing an irretrievable breakdown, an identification of the property dissipated, and the time during which the dissipation occurred; the notice shall be filed and served pursuant to applicable rules; and no dissipation shall be deemed to have occurred prior to 5 years before the filing of the petition for dissolution of marriage or 3 years after the party claiming dissipation knew or should have known of the dissipation.

Adds reference to:
750 ILCS 5/505from Ch. 40, par. 505

Replaces everything after the enacting clause. Re-inserts the changes made by the introduced bill and adds language providing that those changes apply only to petitions for dissolution of marriage filed on or after the effective date of the amendatory Act. Further amends the Illinois Marriage and Dissolution of Marriage Act. In language regarding the factors that a court may consider in finding that a deviation from child support guidelines is appropriate, changes the factor of "the physical and emotional condition of the child, and his educational needs" to "the physical, mental, and emotional needs of the child" and adds "the educational needs of the child" as a separate factor. Makes other changes regarding those factors. Provides that the court, in its discretion, in addition to setting child support pursuant to the guidelines and factors, may order either or both parents owing a duty of support to a child of the marriage to contribute to expenses for health needs not covered by insurance, child care, education, and extracurricular activities if determined by the court to be reasonable.
