Synopsis As Introduced
Amends the Special Service Area Tax Law in the Property Tax Code. Requires that the mailed notice of the proposed special service area be mailed by registered mail, return receipt requested, to each resident and landowner in the proposed special service area. Requires that, at the public hearing for the creation of a special service area, the municipality or county shall certify a list of electors who may sign an objection petition. Effective immediately.

Senate Committee Amendment No. 1
Requires that the certified list of eligible objectors also contain the owners of record who may sign an objection petition. Requires that the list be comprised of each person for whom the municipality has received a return receipt for the mailed notice (instead of each person to whom the notice was mailed).

Deletes everything after the enacting clause. Amends the Property Tax Code. In a Section concerning a public hearing held prior to the establishment of a special service area, provides that a list of the names and addresses of the individuals and entities to whom notice of the public hearing was sent by mail shall be made available at the public hearing. Provides that, if a person who is registered to vote has died or has permanently moved from the special service area, and if certified documentation is submitted along with an objection petition, then that person shall not be counted as an elector for purposes of determining whether or not at least 51% of the electors residing within the special service area have signed the objection petition.
