Synopsis As Introduced
Amends the Illinois Income Tax Act. Requires an addition modification to base income of an amount equal to the contribution component of any nonqualified withdrawal from a tuition savings program that was previously deducted from base income. Effective immediately.

House Committee Amendment No. 1
Provides that the addition modification must also be made for a refund from a tuition savings program. Requires that the modification be made only if the nonqualified withdrawal or refund did not result from the beneficiary's death, disability, or receipt of a scholarship. Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.
