Replaces everything after the enacting clause. Creates the Chicago Casino Development Authority Act. Provides for the creation of the Chicago Casino Development Authority, whose duties include promotion and maintenance of a casino. Amends the Illinois Horse Racing Act of 1975 and the Riverboat Gambling Act to authorize electronic gaming at race tracks (and makes conforming changes in various Acts). Further amends the Illinois Horse Racing Act of 1975. Makes various changes concerning Board members. Contains provisions concerning testing of horses at county fairs, payments from the Horse Racing Fund, and standardbred horses. Further amends the Riverboat Gambling Act. Changes the short title to the Illinois Gambling Act. Adds additional owners licenses, one of which authorizes the conduct of riverboat or land-based gambling in the City of Chicago. Makes changes in provisions concerning the admission tax and privilege tax. Makes other changes. Makes corresponding changes in other Acts.

Senate Floor Amendment No. 3
In the Chicago Casino Development Authority Act, extends the prohibition on receiving legal, banking, consulting or other fees related to the issuance of bonds to a company or firm that employs a certain person or his or her spouse if that person or his or her spouse has greater than 7.5% ownership of the company or firm. In the Illinois Horse Racing Act of 1975, makes a change in a provision concerning the percentage of the electronic gaming receipts that shall be paid to the Southern Illinois University Department of Animal Sciences for equine research and education. In the Riverboat Gambling Act (now, the Illinois Gambling Act), provides that, subject to appropriation, a certain amount shall be distributed to the Village of Melrose Park and Cook County from the tax imposed on an electronic gaming facility that is located in an unincorporated area of Cook County and has been awarded standardbred racing dates during 2010 by the Illinois Racing Board. Makes changes to a provision concerning certain owners licensees located within 15 miles of the Missouri border. Makes technical changes. Makes other changes.

Senate Floor Amendment No. 4
In the Riverboat Gambling Act (now, Illinois Gambling Act), provides that subject to the approval of the Illinois Gaming Board, an organization licensee that (i) receives an electronic gaming license under the Act and (ii) has operating control of a race track facility located in Cook County, may relocate its race track facility within Cook County in conjunction with plans to construct a new structure for purposes of electronic gaming at a location within a 3-mile radius of its existing race track facility.

In the Chicago Casino Development Authority Act, makes changes in a provision concerning the number of appointed members on the Advisory Committee. Provides that gaming in any Chicago airport must be (1) conducted beyond the Transportation Security Administration security checkpoints and (2) limited to slot machines. Provides that 60% of gaming endowment funds shall be used for or pledged for, in addition to certain other purposes, the construction and maintenance of facilities at Navy Pier that are owned by the Metropolitan Pier and Exposition Authority. Amends the State Officials and Employees Ethics Act. Provides that employees of the Illinois Racing Board and Illinois Gaming Board shall be subject to a certain revolving door prohibition of the Act. In the State Finance Act, changes the percentage of revenues in the Gaming Facilities Fee Revenue Fund that must be transferred to the Capital Projects Fund for capital projects. In the Riverboat Gambling Act (now, the Illinois Gambling Act), provides that an owners licensee may conduct gaming at a temporary facility pending the construction of a permanent facility or the remodeling or relocation of an existing facility to accommodate gaming participants for up to 24 months after the temporary facility begins to conduct gaming. provides that on or after January 1, 2012 or upon relocating its facilities, all casinos, riverboats, and electronic gaming facilities shall consist of buildings that are certified as meeting the U.S. Green Building Council's Leadership in Energy and Environmental Design standards. Makes changes to a provision concerning relocation of a race track facility located in Cook County. Makes changes to provisions requiring that an amount equal to 2% of adjusted gross receipts of certain owners licensees be paid from the State Gaming Fund to certain home rule counties and Chicago State University. Adds provisions concerning the issuance of new owners licenses. Provides specific date ranges for which certain privilege taxes shall be imposed on persons engaged in the business of conducting riverboat or casino gambling or electronic gaming operations. Makes changes concerning the privilege tax rates for table games. Provides that a certain percentage of the tax revenue generated by electronic gaming facilities located in the Village of Arlington Heights be paid to the Village of Arlington Heights and the City of Des Plaines. Makes other changes. Also makes technical changes. Adds an immediate effective date.

 Based upon current bargaining unit contracts and rates, the Illinois Gaming Board projects an increase in its headcount by 320 full-time equivalents, and the respective additional costs to be approximately $51 million to oversee and regulate gaming as proposed in SB 737 (H-Am 1). The Illinois Gaming Board anticipates that costs would continue to increase in future years due to the timeframe associated with the implementing of this expansion of gaming.
