1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Sections 7-42 and 17-15 as follows:
 
6    (10 ILCS 5/7-42)  (from Ch. 46, par. 7-42)
7    Sec. 7-42.
8    (a) Any person entitled to vote at such primary shall, on
9the day of such primary, with the consent of his employer be
10entitled to absent himself from any service or employment in
11which he is then engaged or employed for a period of two hours
12between the time of opening and closing the polls. The employer
13may specify the hours during which said employe may absent
14himself.
15    (b) Beginning the 15th day before the primary election or
16on the day of the primary election, any student entitled to
17vote at such primary shall be entitled to be absent from school
18for a period of 2 hours during the school day in order to vote.
19The school may specify the hours during which the eligible
20student may be absent. A student who is absent from school
21under this subsection (b) is not considered absent for the
22purpose of calculating enrollment under Section 18-8.15 of the
23School Code.

3    Sec. 17-15.
4    (a) Any person entitled to vote at a general or special
5election or at any election at which propositions are submitted
6to a popular vote in this State, shall, on the day of such
7election, be entitled to absent himself from any services or
8employment in which he is then engaged or employed, for a
9period of 2 hours between the time of opening and closing the
10polls; and such voter shall not because of so absenting himself
11be liable to any penalty; Provided, however, that application
12for such leave of absence shall be made prior to the day of
13election. The employer may specify the hours during which said
14employee may absent himself as aforesaid, except that the
15employer must permit a 2-hour absence during working hours if
16the employee's working hours begin less than 2 hours after the
17opening of the polls and end less than 2 hours before the
18closing of the polls. No person or corporation shall refuse to
19an employee the privilege hereby conferred, nor shall subject
20an employee to a penalty, including a reduction in compensation
21due to an absence under this Section, because of the exercise
22of such privilege, nor shall directly or indirectly violate the
23provisions of this Section.
24    (b) Beginning the 15th day before a general or special

1a popular vote in this State or on the day of a general or
2special election or any election at which propositions are
3submitted to a popular vote in this State, any student entitled
4to vote at such election shall be entitled to be absent from
5school for a period of 2 hours during the school day in order
6to vote. The school may specify the hours during which the
7eligible student may be absent. A student who is absent from
8school under this subsection (b) is not considered absent for
9the purpose of calculating enrollment under Section 18-8.15 of
10the School Code.
