SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/1-25 new

    Amends the Election Code. Provides that an election authority shall not locate a polling place for early voting, grace period registration and voting, or election day voting in a building permanently occupied by a local or State law enforcement agency. Provides an exception for an election authority with an office in a building occupied by local or State law enforcement, allowing early voting or grace period registration and voting at that site, provided that the election authority operates a permanent or temporary early voting or grace period registration and voting polling location in at least one location that is not located in a building occupied by a local or State law enforcement agency. Provides that an election authority with an office in a building occupied by local or State law enforcement may conduct election day voting at the site, provided the election authority operates an election day voting polling location in at least one location that is not located in a building occupied by a local or State law enforcement agency. Clarifies that these provisions do not prohibit an election authority from conducting early voting or grace period registration and voting at the student union on the campus of a public university due to presence of a university law enforcement office. Effective immediately.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by adding Section
51-25 as follows:
 
6    (10 ILCS 5/1-25 new)
7    Sec. 1-25. Law enforcement; polling places.
8    (a) Notwithstanding any other law to the contrary, an
9election authority shall not locate a polling place for early
10voting, grace period registration and voting, or election day
11voting in a building permanently occupied by a local or State
12law enforcement agency unless otherwise permitted by this
13Section.
14    (b) An election authority with an office in a building
15occupied by local or State law enforcement may conduct early
16voting or grace period registration and voting at the site,
17provided the election authority operates a permanent or
18temporary early voting or grace period registration and voting
19polling location in at least one location that is not located
20in a building occupied by a local or State law enforcement
21agency.
22    (c) An election authority with an office in a building
23occupied by local or State law enforcement may conduct election

5    (d) Nothing in this Section shall prohibit an election
6authority from conducting early voting, grace period
7registration and voting, or election day voting at the student
8union on the campus of a public university due to presence of a
9university law enforcement office.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.
