SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/1-101.8  from Ch. 95 1/2, par. 1-102.02
625 ILCS 5/1-168.8

    Amends the Illinois Vehicle Code. Changes the definition of "all-terrain vehicle by: (1) changing the size limitation to 55 (rather than 50) inches measured from the outside of the tire rim to the outside of the tire rim; and (2) removing specific design requirements. Changes the definition of "recreational off-highway vehicle" by changing the size limitation to 80 (rather than 64) inches or less in width measured from the outside of the tire rim to the outside of the tire rim. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 1-101.8 and 1-168.8 as follows:
 
6    (625 ILCS 5/1-101.8)  (from Ch. 95 1/2, par. 1-102.02)
7    Sec. 1-101.8. All-terrain vehicle. Any motorized
8off-highway device designed to travel primarily off-highway,
955 50 inches or less in width measured from the outside of the
10tire rim to the outside of the tire rim, having a
11manufacturer's dry weight of 1,500 pounds or less, traveling on
123 or more non-highway tires, designed with a seat or saddle for
13operator use, and handlebars or steering wheel for steering
14control, except equipment such as lawnmowers.

17    Sec. 1-168.8. Recreational off-highway vehicle. Any
18motorized off-highway device designed to travel primarily
19off-highway, 80 64 inches or less in width measured from the
20outside of the tire rim to the outside of the tire rim, having
21a manufacturer's dry weight of 2,000 pounds or less, traveling
22on 4 or more non-highway tires, designed with a non-straddle

2equipment such as lawnmowers.
