    Amends the Illinois Identification Card Act. Provides for the issuance of standard Illinois Identification Cards and limited-term Illinois Identification Cards free of charge to persons upon release from a county jail. Makes conforming changes.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Identification Card Act is amended
5by changing Sections 4 and 12 as follows:
 
6    (15 ILCS 335/4)  (from Ch. 124, par. 24)
7    Sec. 4. Identification card.
8    (a) The Secretary of State shall issue a standard Illinois
9Identification Card to any natural person who is a resident of
10the State of Illinois who applies for such card, or renewal
11thereof. No identification card shall be issued to any person
12who holds a valid foreign state identification card, license,
13or permit unless the person first surrenders to the Secretary
14of State the valid foreign state identification card, license,
15or permit. The card shall be prepared and supplied by the
16Secretary of State and shall include a photograph and signature
17or mark of the applicant. However, the Secretary of State may
18provide by rule for the issuance of Illinois Identification
19Cards without photographs if the applicant has a bona fide
20religious objection to being photographed or to the display of
21his or her photograph. The Illinois Identification Card may be
22used for identification purposes in any lawful situation only
23by the person to whom it was issued. As used in this Act,

1"photograph" means any color photograph or digitally produced
2and captured image of an applicant for an identification card.
3As used in this Act, "signature" means the name of a person as
4written by that person and captured in a manner acceptable to
5the Secretary of State.
6    (a-5) If an applicant for an identification card has a
7current driver's license or instruction permit issued by the
8Secretary of State, the Secretary may require the applicant to
9utilize the same residence address and name on the
10identification card, driver's license, and instruction permit
11records maintained by the Secretary. The Secretary may
12promulgate rules to implement this provision.
13    (a-10) If the applicant is a judicial officer as defined in
14Section 1-10 of the Judicial Privacy Act or a peace officer,
15the applicant may elect to have his or her office or work
16address listed on the card instead of the applicant's residence
17or mailing address. The Secretary may promulgate rules to
18implement this provision. For the purposes of this subsection
19(a-10), "peace officer" means any person who by virtue of his
20or her office or public employment is vested by law with a duty
21to maintain public order or to make arrests for a violation of
22any penal statute of this State, whether that duty extends to
23all violations or is limited to specific violations.
24    (a-15) The Secretary of State may provide for an expedited
25process for the issuance of an Illinois Identification Card.
26The Secretary shall charge an additional fee for the expedited

1issuance of an Illinois Identification Card, to be set by rule,
2not to exceed $75. All fees collected by the Secretary for
3expedited Illinois Identification Card service shall be
4deposited into the Secretary of State Special Services Fund.
5The Secretary may adopt rules regarding the eligibility,
6process, and fee for an expedited Illinois Identification Card.
7If the Secretary of State determines that the volume of
8expedited identification card requests received on a given day
9exceeds the ability of the Secretary to process those requests
10in an expedited manner, the Secretary may decline to provide
11expedited services, and the additional fee for the expedited
12service shall be refunded to the applicant.
13    (a-20) The Secretary of State shall issue a standard
14Illinois Identification Card to a committed person upon release
15on parole, mandatory supervised release, aftercare release,
16final discharge, or pardon from the Department of Corrections
17or Department of Juvenile Justice, or upon release from a
18county jail, if the released person presents a certified copy
19of his or her birth certificate, social security card or other
20documents authorized by the Secretary, and 2 documents proving
21his or her Illinois residence address. Documents proving
22residence address may include any official document of the
23Department of Corrections or the Department of Juvenile
24Justice, or any official document of the applicable county
25sheriff, showing the released person's address after release
26and a Secretary of State prescribed certificate of residency

1form, which may be executed by Department of Corrections or
2Department of Juvenile Justice personnel, or by county sheriff
3personnel.
4    (a-25) The Secretary of State shall issue a limited-term
5Illinois Identification Card valid for 90 days to a committed
6person upon release on parole, mandatory supervised release,
7aftercare release, final discharge, or pardon from the
8Department of Corrections or Department of Juvenile Justice, or
9upon release from a county jail, if the released person is
10unable to present a certified copy of his or her birth
11certificate and social security card or other documents
12authorized by the Secretary, but does present a Secretary of
13State prescribed verification form completed by the Department
14of Corrections or Department of Juvenile Justice, or by the
15applicable county sheriff, verifying the released person's
16date of birth and social security number and 2 documents
17proving his or her Illinois residence address. The verification
18form must have been completed no more than 30 days prior to the
19date of application for the Illinois Identification Card.
20Documents proving residence address shall include any official
21document of the Department of Corrections or the Department of
22Juvenile Justice, or any official document of the applicable
23county sheriff, showing the person's address after release and
24a Secretary of State prescribed certificate of residency, which
25may be executed by Department of Corrections or Department of
26Juvenile Justice personnel, or by county sheriff personnel.

1    Prior to the expiration of the 90-day period of the
2limited-term Illinois Identification Card, if the released
3person submits to the Secretary of State a certified copy of
4his or her birth certificate and his or her social security
5card or other documents authorized by the Secretary, a standard
6Illinois Identification Card shall be issued. A limited-term
7Illinois Identification Card may not be renewed.
8    (a-30) The Secretary of State shall issue a standard
9Illinois Identification Card to a person upon conditional
10release or absolute discharge from the custody of the
11Department of Human Services, if the person presents a
12certified copy of his or her birth certificate, social security
13card, or other documents authorized by the Secretary, and a
14document proving his or her Illinois residence address. The
15Secretary of State shall issue a standard Illinois
16Identification Card to a person no sooner than 14 days prior to
17his or her conditional release or absolute discharge if
18personnel from the Department of Human Services bring the
19person to a Secretary of State location with the required
20documents. Documents proving residence address may include any
21official document of the Department of Human Services showing
22the person's address after release and a Secretary of State
23prescribed verification form, which may be executed by
24personnel of the Department of Human Services.
25    (a-35) The Secretary of State shall issue a limited-term
26Illinois Identification Card valid for 90 days to a person upon

1conditional release or absolute discharge from the custody of
2the Department of Human Services, if the person is unable to
3present a certified copy of his or her birth certificate and
4social security card or other documents authorized by the
5Secretary, but does present a Secretary of State prescribed
6verification form completed by the Department of Human
7Services, verifying the person's date of birth and social
8security number, and a document proving his or her Illinois
9residence address. The verification form must have been
10completed no more than 30 days prior to the date of application
11for the Illinois Identification Card. The Secretary of State
12shall issue a limited-term Illinois Identification Card to a
13person no sooner than 14 days prior to his or her conditional
14release or absolute discharge if personnel from the Department
15of Human Services bring the person to a Secretary of State
16location with the required documents. Documents proving
17residence address shall include any official document of the
18Department of Human Services showing the person's address after
19release and a Secretary of State prescribed verification form,
20which may be executed by personnel of the Department of Human
21Services.
22    (b) The Secretary of State shall issue a special Illinois
23Identification Card, which shall be known as an Illinois Person
24with a Disability Identification Card, to any natural person
25who is a resident of the State of Illinois, who is a person
26with a disability as defined in Section 4A of this Act, who

1applies for such card, or renewal thereof. No Illinois Person
2with a Disability Identification Card shall be issued to any
3person who holds a valid foreign state identification card,
4license, or permit unless the person first surrenders to the
5Secretary of State the valid foreign state identification card,
6license, or permit. The Secretary of State shall charge no fee
7to issue such card. The card shall be prepared and supplied by
8the Secretary of State, and shall include a photograph and
9signature or mark of the applicant, a designation indicating
10that the card is an Illinois Person with a Disability
11Identification Card, and shall include a comprehensible
12designation of the type and classification of the applicant's
13disability as set out in Section 4A of this Act. However, the
14Secretary of State may provide by rule for the issuance of
15Illinois Person with a Disability Identification Cards without
16photographs if the applicant has a bona fide religious
17objection to being photographed or to the display of his or her
18photograph. If the applicant so requests, the card shall
19include a description of the applicant's disability and any
20information about the applicant's disability or medical
21history which the Secretary determines would be helpful to the
22applicant in securing emergency medical care. If a mark is used
23in lieu of a signature, such mark shall be affixed to the card
24in the presence of two witnesses who attest to the authenticity
25of the mark. The Illinois Person with a Disability
26Identification Card may be used for identification purposes in

1any lawful situation by the person to whom it was issued.
2    The Illinois Person with a Disability Identification Card
3may be used as adequate documentation of disability in lieu of
4a physician's determination of disability, a determination of
5disability from a physician assistant, a determination of
6disability from an advanced practice registered nurse, or any
7other documentation of disability whenever any State law
8requires that a person with a disability provide such
9documentation of disability, however an Illinois Person with a
10Disability Identification Card shall not qualify the
11cardholder to participate in any program or to receive any
12benefit which is not available to all persons with like
13disabilities. Notwithstanding any other provisions of law, an
14Illinois Person with a Disability Identification Card, or
15evidence that the Secretary of State has issued an Illinois
16Person with a Disability Identification Card, shall not be used
17by any person other than the person named on such card to prove
18that the person named on such card is a person with a
19disability or for any other purpose unless the card is used for
20the benefit of the person named on such card, and the person
21named on such card consents to such use at the time the card is
22so used.
23    An optometrist's determination of a visual disability
24under Section 4A of this Act is acceptable as documentation for
25the purpose of issuing an Illinois Person with a Disability
26Identification Card.

1    When medical information is contained on an Illinois Person
2with a Disability Identification Card, the Office of the
3Secretary of State shall not be liable for any actions taken
4based upon that medical information.
5    (c) The Secretary of State shall provide that each original
6or renewal Illinois Identification Card or Illinois Person with
7a Disability Identification Card issued to a person under the
8age of 21 shall be of a distinct nature from those Illinois
9Identification Cards or Illinois Person with a Disability
10Identification Cards issued to individuals 21 years of age or
11older. The color designated for Illinois Identification Cards
12or Illinois Person with a Disability Identification Cards for
13persons under the age of 21 shall be at the discretion of the
14Secretary of State.
15    (c-1) Each original or renewal Illinois Identification
16Card or Illinois Person with a Disability Identification Card
17issued to a person under the age of 21 shall display the date
18upon which the person becomes 18 years of age and the date upon
19which the person becomes 21 years of age.
20    (c-3) The General Assembly recognizes the need to identify
21military veterans living in this State for the purpose of
22ensuring that they receive all of the services and benefits to
23which they are legally entitled, including healthcare,
24education assistance, and job placement. To assist the State in
25identifying these veterans and delivering these vital services
26and benefits, the Secretary of State is authorized to issue

1Illinois Identification Cards and Illinois Person with a
2Disability Identification Cards with the word "veteran"
3appearing on the face of the cards. This authorization is
4predicated on the unique status of veterans. The Secretary may
5not issue any other identification card which identifies an
6occupation, status, affiliation, hobby, or other unique
7characteristics of the identification card holder which is
8unrelated to the purpose of the identification card.
9    (c-5) Beginning on or before July 1, 2015, the Secretary of
10State shall designate a space on each original or renewal
11identification card where, at the request of the applicant, the
12word "veteran" shall be placed. The veteran designation shall
13be available to a person identified as a veteran under
14subsection (b) of Section 5 of this Act who was discharged or
15separated under honorable conditions.
16    (d) The Secretary of State may issue a Senior Citizen
17discount card, to any natural person who is a resident of the
18State of Illinois who is 60 years of age or older and who
19applies for such a card or renewal thereof. The Secretary of
20State shall charge no fee to issue such card. The card shall be
21issued in every county and applications shall be made available
22at, but not limited to, nutrition sites, senior citizen centers
23and Area Agencies on Aging. The applicant, upon receipt of such
24card and prior to its use for any purpose, shall have affixed
25thereon in the space provided therefor his signature or mark.
26    (e) The Secretary of State, in his or her discretion, may

1designate on each Illinois Identification Card or Illinois
2Person with a Disability Identification Card a space where the
3card holder may place a sticker or decal, issued by the
4Secretary of State, of uniform size as the Secretary may
5specify, that shall indicate in appropriate language that the
6card holder has renewed his or her Illinois Identification Card
7or Illinois Person with a Disability Identification Card.

14Identification Cards must accompany any application provided
15for in this Act, and the Secretary shall collect such fees as

20    All fees collected under this Act shall be paid into the
21Road Fund of the State treasury, except that the following
22amounts shall be paid into the General Revenue Fund: (i) 80% of
23the fee for an original, renewal, or duplicate Illinois
24Identification Card issued on or after January 1, 2005; and
25(ii) 80% of the fee for a corrected Illinois Identification
26Card issued on or after January 1, 2005.

1    An individual, who resides in a veterans home or veterans
2hospital operated by the State or federal government, who makes
3an application for an Illinois Identification Card to be issued
4at no fee, must submit, along with the application, an
5affirmation by the applicant on a form provided by the
6Secretary of State, that such person resides in a veterans home
7or veterans hospital operated by the State or federal
8government.
9    The application of a homeless individual for an Illinois
10Identification Card to be issued at no fee must be accompanied
11by an affirmation by a qualified person, as defined in Section
124C of this Act, on a form provided by the Secretary of State,
13that the applicant is currently homeless as defined in Section
141A of this Act.
15    For the application for the first Illinois Identification
16Card of a youth for whom the Department of Children and Family
17Services is legally responsible or a foster child to be issued
18at no fee, the youth must submit, along with the application,
19an affirmation by his or her court appointed attorney or an
20employee of the Department of Children and Family Services on a
21form provided by the Secretary of State, that the person is a
22youth for whom the Department of Children and Family Services
23is legally responsible or a foster child.
24    The fee for any duplicate identification card shall be
25waived for any person who presents the Secretary of State's
26Office with a police report showing that his or her

1identification card was stolen.
2    The fee for any duplicate identification card shall be
3waived for any person age 60 or older whose identification card
4has been lost or stolen.
5    As used in this Section, "active-duty member of the United
6States Armed Forces" means a member of the Armed Services or
7Reserve Forces of the United States or a member of the Illinois
8National Guard who is called to active duty pursuant to an
9executive order of the President of the United States, an act
10of the Congress of the United States, or an order of the
11Governor.
