1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 3-405 and 3-416 as follows:
 
6     (625 ILCS 5/3-405)  (from Ch. 95 1/2, par. 3-405)
7     Sec. 3-405. Application for registration.
8     (a) Every owner of a vehicle subject to registration under
9 this Code shall make application to the Secretary of State for
10 the registration of such vehicle upon the appropriate form or
11 forms furnished by the Secretary. Every such application shall
12 bear the signature of the owner written with pen and ink and
13 contain:
14         1. The name, domicile address, as defined in Section
15     1-115.5 of this Code, bona fide residence (except as
16     otherwise provided in this paragraph 1) and mail address of
17     the owner or business address of the owner if a firm,
18     association or corporation. If the mailing address is a
19     post office box number, the address listed on the driver
20     license record may be used to verify residence. A police
21     officer, a deputy sheriff, an elected sheriff, a law
22     enforcement officer for the Department of State Police, or
23     a fire investigator may elect to furnish the address of the

1     headquarters of the governmental entity or police district
2     where he or she works instead of his or her domicile
3     residence address, in which case that address shall be
4     deemed to be his or her domicile residence address for all
5     purposes under this Chapter 3. The spouse and children of a
6     person who may elect under this paragraph 1 to furnish the
7     address of the headquarters of the government entity or
8     police district where the person works instead of the
9     person's domicile residence address may, if they reside
10     with that person, also elect to furnish the address of the
11     headquarters of the government entity or police district
12     where the person works as their domicile residence address,
13     in which case that address shall be deemed to be their
14     domicile residence address for all purposes under this
15     Chapter 3. In this paragraph 1: (A) "police officer" has
16     the meaning ascribed to "policeman" in Section 10-3-1 of
17     the Illinois Municipal Code; (B) "deputy sheriff" means a
18     deputy sheriff appointed under Section 3-6008 of the
19     Counties Code; (C) "elected sheriff" means a sheriff
20     commissioned pursuant to Section 3-6001 of the Counties
21     Code; and (D) "fire investigator" means a person classified
22     as a peace officer under the Peace Officer Fire
23     Investigation Act.
24         2. A description of the vehicle, including such
25     information as is required in an application for a
26     certificate of title, determined under such standard

1     rating as may be prescribed by the Secretary.
2         3. Information relating to the insurance policy for the
3     motor vehicle, including the name of the insurer which
4     issued the policy, the policy number, and the expiration
5     date of the policy.
6         4. Such further information as may reasonably be
7     required by the Secretary to enable him to determine
8     whether the vehicle is lawfully entitled to registration
9     and the owner entitled to a certificate of title.
10         5. An affirmation by the applicant that all information
11     set forth is true and correct. If the application is for
12     the registration of a motor vehicle, the applicant also
13     shall affirm that the motor vehicle is insured as required
14     by this Code, that such insurance will be maintained
15     throughout the period for which the motor vehicle shall be
16     registered, and that neither the owner, nor any person
17     operating the motor vehicle with the owner's permission,
18     shall operate the motor vehicle unless the required
19     insurance is in effect. If the person signing the
20     affirmation is not the sole owner of the vehicle, such
21     person shall be deemed to have affirmed on behalf of all
22     the owners of the vehicle. If the person signing the
23     affirmation is not an owner of the vehicle, such person
24     shall be deemed to have affirmed on behalf of the owner or
25     owners of the vehicle. The lack of signature on the
26     application shall not in any manner exempt the owner or

1     owners from any provisions, requirements or penalties of
2     this Code.
3     (b) When such application refers to a new vehicle purchased
4 from a dealer the application shall be accompanied by a
5 Manufacturer's Statement of Origin from the dealer, and a
6 statement showing any lien retained by the dealer.

9     Sec. 3-416. Notice of change of address or name.
10     (a) Whenever any person after making application for or
11 obtaining the registration of a vehicle shall move from the
12 address named in the application or shown upon a registration
13 card such person shall within 10 days thereafter notify the
14 Secretary of State of his or her old and new address.
15     (a-5) A police officer, a deputy sheriff, an elected
16 sheriff, a law enforcement officer for the Department of State
17 Police, or a fire investigator who, in accordance with Section
18 3-405, has furnished the address of the office of the
19 headquarters of the governmental entity or police district
20 where he or she works instead of his or her domicile residence
21 address shall, within 10 days after he or she is no longer
22 employed by that governmental entity or police district as a
23 police officer, a deputy sheriff, an elected sheriff, a law
24 enforcement officer for the Department of State Police or a
25 fire investigator, notify the Secretary of State of the old

1 address and his or her new address. If, in accordance with
2 Section 3-405, the spouse and children of a police officer,
3 deputy sheriff, elected sheriff, law enforcement officer for
4 the Department of State Police, or fire investigator have
5 furnished the address of the office of the headquarters of the
6 governmental entity or police district where the police
7 officer, deputy sheriff, elected sheriff, law enforcement
8 officer for the Department of State Police, or fire
9 investigator works instead of their domicile residence
10 address, the spouse and children shall notify the Secretary of
11 State of their old address and new address within 10 days after
12 the police officer, deputy sheriff, elected sheriff, law
13 enforcement officer for the Department of State Police, or fire
14 investigator is no longer employed by that governmental entity
15 or police district as a police officer, deputy sheriff, elected
16 sheriff, law enforcement officer for the Department of State
17 Police, or fire investigator.
18     (b) Whenever the name of any person who has made
19 application for or obtained the registration of a vehicle is
20 thereafter changed by marriage or otherwise such person shall
21 within 10 days notify the Secretary of State of such former and
22 new name.
23     (c) In either event, any such person may obtain a corrected
24 registration card or certificate of title upon application and
25 payment of the statutory fee.
