SYNOPSIS AS INTRODUCED:
 
225 ILCS 470/23.5 new

    Amends the Weights and Measures Act. Provides that the Department of Agriculture shall conduct a survey on the effect of temperatures on fuel deliveries. Provides that the survey shall be conducted during routine dispenser inspections by determining the accuracy of fuel delivery and by recording fuel temperature, air temperature, and storage tank temperature at fuel stations and other fuel facilities subject to inspection. Provides that the Department shall submit the results of the survey to the Illinois Environmental Protection Agency, which shall conduct a cost-benefit analysis and comparison of various options relative to temperature-corrected gallonage temperatures. Provides that the Agency shall evaluate how different reference temperatures or temperature correction devices apply to alternative fuels and low-carbon fuel standards. Provides that the Agency shall convene an advisory group no later than January 25, 2009, that includes, but is not limited to, equipment manufacturers, consumer groups, fuel industry representatives, agricultural commissioners, appropriate government agencies, and other interested parties to provide guidance on the study pursuant to specified provisions and to provide guidance on the analysis and recommendations. Provides that the Agency, in partnership with the Department, shall conduct public hearings on the cost-benefit analysis and report to the General Assembly regarding recommended legislation and regulations based on the results of the study not later than December 31, 2009. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Weights and Measures Act is amended by
5 adding Section 23.5 as follows:
 
6     (225 ILCS 470/23.5 new)
7     Sec. 23.5. Fuel temperature delivery study.
8     (a) The Department shall conduct a survey on the effect of
9 temperatures on fuel deliveries. The survey shall be conducted
10 during routine dispenser inspections by determining the
11 accuracy of fuel delivery and by recording fuel temperature,
12 air temperature, and storage tank temperature at fuel stations
13 and other fuel facilities subject to inspection. The Department
14 shall use data collected beginnning on April 1, 2008 and
15 through March 31, 2009.
16     (b) The Department shall submit the results of the survey
17 to the Illinois Environmental Protection Agency, which shall
18 conduct a cost-benefit analysis and comparison of various
19 options relative to temperature-corrected gallonage
20 temperatures the following:
21         (1) Retaining the current reference temperature.
22         (2) Establishing a different statewide reference
23     temperature.

1         (3) Establishing different regional reference
2     temperatures for the State.
3         (4) Requiring the installation of temperature
4     correction or compensation equipment at the pump.
5     (c) The Agency shall evaluate how different reference
6 temperatures or temperature correction devices apply to
7 alternative fuels and low-carbon fuel standards.
8     (d) The Agency shall convene an advisory group no later
9 than January 25, 2009, that includes, but is not limited to,
10 equipment manufacturers, consumer groups, fuel industry
11 representatives, agricultural commissioners, appropriate
12 government agencies, and other interested parties to provide
13 guidance on the study pursuant to this Section and to provide
14 guidance on the analysis and recommendations.
15     (e) The Agency, in partnership with the Department, shall
16 conduct public hearings on the cost-benefit analysis and report
17 to the General Assembly regarding recommended legislation and
18 regulations based on the results of the study not later than
19 December 31, 2009.
20     (f) For purposes of this Section, "Agency" means the
21 Illinois Environmental Protection Agency.
 
22     Section 99. Effective date. This Act takes effect upon
23 becoming law.
