SYNOPSIS AS INTRODUCED:
 
745 ILCS 10/1-206  from Ch. 85, par. 1-206

    Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that "local public entity" includes any not-for-profit corporation authorized by agreement with a local governmental body to operate a museum, zoological park, horticultural park or garden, aquarium, or other cultural institution on land owned by a municipality, county, park district, or forest preserve district. Provides that the changes are declarative of existing law.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Local Governmental and Governmental
5Employees Tort Immunity Act is amended by changing Section
61-206 as follows:
 
7    (745 ILCS 10/1-206)  (from Ch. 85, par. 1-206)
8    Sec. 1-206. "Local public entity" includes a county,
9township, municipality, municipal corporation, school
10district, school board, educational service region, regional
11board of school trustees, trustees of schools of townships,
12treasurers of schools of townships, community college
13district, community college board, forest preserve district,
14park district, fire protection district, sanitary district,
15museum district, emergency telephone system board, and all
16other local governmental bodies. "Local public entity" also
17includes library systems and any intergovernmental agency or
18similar entity formed pursuant to the Constitution of the State
19of Illinois or the Intergovernmental Cooperation Act as well as
20any not-for-profit corporation organized for the purpose of
21conducting public business, including any not-for-profit
22corporation authorized by agreement with a local governmental
23body to operate a museum, zoological park, horticultural park

1or garden, aquarium, or other cultural institution on land
2owned by a municipality, county, park district, or forest
3preserve district. It does not include the State or any office,
4officer, department, division, bureau, board, commission,
5university or similar agency of the State.
6    The changes made by this amendatory Act of the 94th General
7Assembly do not apply to an action or proceeding accruing on or
8before its effective date. The changes made by this amendatory
9Act of the 99th General Assembly are declarative of existing
10law.
