    Amends the Illinois Public Aid Code. Makes a technical change in a Section concerning case management services.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-16.1 as follows:
 
6    (305 ILCS 5/5-16.1)  (from Ch. 23, par. 5-16.1)
7    Sec. 5-16.1. Case Management Services. The The Illinois
8Department may develop, implement and evaluate a Case
9Management Services Program which provides services consistent
10with the provisions of this Section, and the Inter-Agency
11Agreement between the Department of Healthcare and Family
12Services (formerly Department of Public Aid) and the Department
13of Public Health, for a targeted population on a less than
14Statewide basis in the State of Illinois. The purpose of this
15Case Management Services Program shall be to assist eligible
16participants in gaining access to needed medical, social,
17educational and other services thereby reducing the likelihood
18of long-term welfare dependency. The Case Management Services
19Program shall have the following characteristics:
20        (a) It shall be conducted for a period of no less than
21    5 consecutive fiscal years in one urban area containing a
22    high proportion, as determined by Department of Healthcare
23    and Family Services and Department of Public Health

1    records, of Medicaid eligible pregnant or parenting girls
2    under 17 years of age at the time of the initial assessment
3    and in one rural area containing a high proportion, as
4    determined by Department of Healthcare and Family Services
5    and Department of Public Health records, of Medicaid
6    eligible pregnant or parenting girls under 17 years of age
7    at the time of the initial assessment.
8        (b) Providers participating in the program shall be
9    paid an amount per patient per month, to be set by the
10    Illinois Department, for the case management services
11    provided.
12        (c) Providers eligible to participate in the program
13    shall be nurses or social workers, licensed to practice in
14    Illinois, who comply with the rules and regulations
15    established by the Illinois Department and the
16    Inter-Agency Agreement between the Department of
17    Healthcare and Family Services (formerly Department of
18    Public Aid) and the Department of Public Health. The
19    Illinois Department may terminate a provider's
20    participation in the program if the provider is determined
21    to have failed to comply with any applicable program
22    standard or procedure established by the Illinois
23    Department.
24        (d) Each eligible participant in an area where the Case
25    Management Services Program is being conducted may
26    voluntarily designate a case manager, of her own choosing

1    to assume responsibility for her care.
2        (e) A participant may change her designated case
3    manager provided that she informs the Illinois Department
4    by the 20th day of the month in order for the change to be
5    effective in the following month.
6        (f) The Illinois Department shall, by rule, establish
7    procedures for providing case management services when the
8    designated source becomes unavailable or wishes to
9    withdraw from any obligation as case management services
10    provider.
11        (g) In accordance with rules adopted by the Illinois
12    Department, a participant may discontinue participation in
13    the program upon timely notice to the Illinois Department,
14    in which case the participant shall remain eligible for
15    assistance under all applicable provisions of Article V of
16    this Code.
17    The Illinois Department shall take any necessary steps to
18obtain authorization or waiver under federal law to implement a
19Case Management Services Program. Participation shall be
20voluntary for the provider and the recipient.
