SYNOPSIS AS INTRODUCED:

305 ILCS 5/4-8a new

Amends the Temporary Assistance for Needy Families Article of the Illinois Public Aid Code. Provides that no person shall knowingly use or accept cash assistance benefits provided under the Temporary Assistance for Needy Families Program for the purchase or sale of certain services or products, including alcoholic beverages, lottery tickets, firearms or firearms ammunition, admission to any performance, gambling games, and rental goods.

AN ACT concerning public aid.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Public Aid Code is amended by adding Section 4-8a as follows:

(305 ILCS 5/4-8a new)

Sec. 4-8a. Prohibited services or products for purchase using cash assistance benefits. No person shall knowingly use or accept cash assistance benefits provided under this Article for the purchase or sale of any of the following services or products:

(1) Alcoholic beverages.

(2) Lottery tickets.

(3) Tobacco products. For purposes of this Section, "tobacco products" means cigarettes, cigars, smokeless tobacco, or tobacco in any of its forms.

(4) Any visual material intended to creat or simulate sexual conduct or sexual excitement. For purposes of this Section, the terms "sexual conduct" and "sexual excitement" shall have the meanings ascribed to those terms in Section 11-21 of the Criminal Code of 2012.

(5) Firearms or firearms ammunition. For purposes of this Section, the terms "firearm" and "firearm ammunition" shall have the meanings ascribed to those terms in Section 31A-0.1 of the Criminal Code of 2012.

(6) Admission to any performance.

(7) Cosmetics.

(8) Professional services, excluding medical care.

(9) Travel services.

(10) Other services, excluding childcare services or memberships provided by health clubs.

(11) Tattoos or other body art or piercings.

(12) Jewelry.

(13) Rental of goods.

(14) The payment of taxes, fees, or penalties, including restitution or bail or bail bonds ordered by a court.

(15) Gambling games. For purposes of this Section, the term "gambling games" shall have the meaning ascribed to that term in the Riverboat Gambling Act.
