SYNOPSIS AS INTRODUCED:

815 ILCS 505/2QQQ new

Amends the Consumer Fraud and Deceptive Business Practices Act. Prohibits an offer of a product or service to a consumer for a free trial period if, as a result of accepting the product or service for the free trial period, the consumer is required to contact the merchant to avoid receiving additional products or services and incurring a financial obligation for those additional products or services. Provides that a violation constitutes an unlawful practice within the meaning of the Act.

AN ACT concerning business.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Consumer Fraud and Deceptive Business Practices Act is amended by adding Section 2QQQ as follows:

Sec. 2QQQ. Charges after trial period. A person may not offer a consumer a product or service for a free trial period if, as a result of accepting the product or service for the free trial period, the consumer is required to contact the merchant to avoid receiving additional products or services and incurring a financial obligation for those additional products or services.

Violation of this Section constitutes an unlawful practice within the meaning of this Act.
