SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/7-183  from Ch. 108 1/2, par. 7-183
30 ILCS 805/8.38 new

    Amends the Illinois Municipal Retirement Fund Article of the Illinois Pension Code. Provides that on July 1, 2015 and no later than each July 1 thereafter, each participating employer shall submit a report annually to the board of trustees of the Fund listing each of its employees during the past 12-month period. Specifies the information to be included in the reports and provides for audits of records. Amends the State Mandates Act to require implementation without reimbursement.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by changing
5Section 7-183 as follows:
 
6    (40 ILCS 5/7-183)  (from Ch. 108 1/2, par. 7-183)
7    Sec. 7-183. To request information.
8    To request such information from any participating or
9covered employee or from any participating or covered
10municipality or instrumentality thereof or participating
11instrumentality as is necessary for the proper operation of the
12fund.
13    On July 1, 2015 and no later than each July 1 thereafter,
14each participating employer shall submit a report annually to
15the Board listing each of its employees during the past
1612-month period. The report shall include all employees as
17defined in Section 7-109, regardless of their participation
18status in the Fund. The report shall include the employee name;
19date of hire; date of termination, if applicable; and
20compensation paid in the previous 12-month period and shall be
21in a format prescribed by the Board.
22    If reports furnished to the Fund under this Section are
23inadequate or if the employer fails to submit the report, the

1Board may provide for such audit of the records of the
2municipality or instrumentality as may be required to determine
3the information requested. The municipality or instrumentality
4shall make its records available to the Fund for the purpose of
5the audit. The cost of the audit shall be paid by the
6municipality or instrumentality to the Fund and shall be due no
7later than 90 days after notification of such charge.

9    Section 90. The State Mandates Act is amended by adding
10Section 8.38 as follows:
 
11    (30 ILCS 805/8.38 new)
12    Sec. 8.38. Exempt mandate. Notwithstanding Sections 6 and 8
13of this Act, no reimbursement by the State is required for the
14implementation of any mandate created by this amendatory Act of
15the 98th General Assembly.
