1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Sections
52-3.157 and 34-18.49 as follows:
 
6    (105 ILCS 5/2-3.157 new)
7    Sec. 2-3.157. City of Chicago School District 299 reports.
8    (a) The State Board of Education shall prepare a report on
9the practices and trends in the operations of City of Chicago
10School District 299 with respect to the impact of charter
11school enrollment on the operation of the school district. The
12State Board of Education shall gather data regarding student
13enrollment and placement policies, disciplinary procedures,
14programs for special education, English Language Learners
15(ELL), and any other relevant student needs for each public
16school in the district, including charter schools. The report
17shall specifically identify any policies that give schools
18latitude to discourage attendance of students or that would
19create barriers for any students to attend. In addition, the
20State Board of Education shall gather data on mobility,
21attendance rates, graduation rates, and incoming and outgoing
22transfers at each grade level for each public school in the
23district, including charter schools. The report shall identify

1the extent to which transfers from charter schools to other
2schools occur before or after any deadlines related to funding.
3The report shall identify the extent to which charter schools
4accept transfers into the school at each grade level, as
5compared to transfers out. The report shall compare charter
6school enrollment by race, disability, income, and ELL status
7to other charter and traditional public schools in the
8district. The report shall compare the instructional programs,
9methods, and instructional materials of each public school in
10the district, including charter schools.
11    The district shall comply with all requests for information
12made by the State Board of Education necessary for the State
13Board of Education to prepare this report.
14    The State Board of Education shall file copies of this
15report as provided in Section 3.1 of the General Assembly
16Organization Act.
17    (b) The State Board of Education shall prepare a report on
18the impact of school actions, such as school closures and
19school turnarounds, on the practices and trends in the
20operation of City of Chicago School District 299. The report
21shall include all of the following:
22        (1) A community analysis that includes current and
23    projected demographics, land usage, transportation plans,
24    residential housing and commercial development, private
25    school plans for water and sewage expansion or
26    redevelopment, and institutions of higher education.

1        (2) A description of the district's guiding
2    educational principles and standards.
3        (3) A description of the types of instructional
4    programs or services delivered at each school.
5        (4) The enrollment capacity of each school and its rate
6    of utilization.
7        (5) A report on the assessment of individual building
8    and site conditions.
9        (6) A data table with historical and projected
10    enrollment data by school and by grade.
11        (7) An analysis of facility needs and requirements of
12    the district.
13        (8) Identification of potential sources of funding for
14    the implementation of the district's Educational Facility
15    Master Plan.
16    The report shall also include identification of all
17external firms and agencies contracted to aid the district in
18performing school actions and transitions. The firms and
19agencies shall disclose financial interests, fees paid by the
20district, and any and all relationships it holds with any
21member of the school board or city council.
22    The district shall comply with all requests for information
23made by the State Board of Education necessary for the State
24Board of Education to prepare this report.
25    The State Board of Education shall file copies of this
26report as provided in Section 3.1 of the General Assembly

1Organization Act.
2    (c) The State Board of Education shall prepare a report on
3the impact of standardized testing on the operations and
4practices of City of Chicago School District 299. The report
5shall include the amount of time educators prepare for tests,
6administer tests, and analyze results. The report shall also
7include the amount of money spent on procuring standardized
8tests. The report shall include the number of tests given to
9students and the frequency of tests at each grade level and at
10each school in the district. The report shall include financial
11disclosures by the company or firm that owns the tests and
12preparation materials that include any prior relationships
13with the district or agents of the district. The report shall
14compare the frequency of tests given to students in schools
15that have charters approved by the district and other district
16schools.
17    The report shall be completed and made available to the
18public each year on or before July 31. If the district does not
19make available all information requested by the State Board of
20Education necessary for the State Board of Education to prepare
21this report, the State Board of Education, in an administrative
22proceeding, shall impose a civil penalty on the district equal
23to $2,900 for every day the information is unavailable after
24the July 31 report date. The Attorney General may bring an
25action in circuit court to enforce the collection of any
26monetary penalty imposed.

1    (d) The State Board of Education may adopt any rules
2necessary to carry out its responsibilities under this Section.
3    (e) The State Board of Education may enter into contracts
4to fulfill the requirements of this Section.
5    (f) City of Chicago School District 299 is responsible for
6all costs associated with the reports required in this Section.
 
7    (105 ILCS 5/34-18.49 new)
8    Sec. 34-18.49. Statement of revenues and in-kind services.
9The district shall create a statement of revenues and in-kind
10services it receives. The statement shall also include the
11value of any in-kind services, payments to third parties, or
12other supports from the district to its charter schools. Any
13support for marketing or recruiting activities, sharing of
14lists of students, or other services must be reported as well.
15The statement must be made available to the public.
