SYNOPSIS AS INTRODUCED:
 
725 ILCS 210/7.06  from Ch. 14, par. 207.06

    Amends the State's Attorneys Appellate Prosecutor's Act. Provides that nothing in the provision requiring an investigator or other employee of the Office of the State's Attorneys Appellate Prosecutor who exercises powers of a peace officer to have a distinct badge prohibits the Director of the Office from issuing a shield or other distinctive identification to an employee not exercising the powers of a peace officer if the Director determines that a shield or distinctive identification is needed by the employee to carry out his or her responsibilities. Effective immediately.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State's Attorneys Appellate Prosecutor's
5Act is amended by changing Section 7.06 as follows:
 
6    (725 ILCS 210/7.06)  (from Ch. 14, par. 207.06)
7    Sec. 7.06. (a) The Director may contract for such
8investigators to provide investigative services in criminal
9cases and tax objection cases for staff counsel and county
10state's attorneys. Investigators may be authorized by the board
11to carry tear gas gun projectors or bombs, pistols, revolvers,
12stun guns, tasers or other firearms.
13    Subject to the qualifications set forth below,
14investigators shall be peace officers and shall have all the
15powers possessed by policemen in cities and by sheriffs;
16provided, that investigators shall exercise such powers
17anywhere in the State only after contact and in cooperation
18with the appropriate local law enforcement agencies.
19    No investigator shall have peace officer status or exercise
20police powers unless he or she successfully completes the basic
21police training course mandated and approved by the Illinois
22Law Enforcement Training Standards Board or such board waives
23the training requirement by reason of the investigator's prior

1law enforcement experience or training or both.
2    The board shall not waive the training requirement unless
3the investigator has had a minimum of 5 years experience as a
4sworn officer of a local, state or federal law enforcement
5agency, 2 of which shall have been in an investigatory
6capacity.
7    (b) The Director must authorize to each investigator
8employed under this Section and to any other employee of the
9Office exercising the powers of a peace officer a distinct
10badge that, on its face, (i) clearly states that the badge is
11authorized by the Office and (ii) contains a unique identifying
12number. Except as otherwise provided in this subsection (b), no
13No other badge shall be authorized by the Office. Nothing in
14this subsection (b) prohibits the Director from issuing a
15shield or other distinctive identification to an employee not
16exercising the powers of a peace officer if the Director
17determines that a shield or distinctive identification is
18needed by the employee to carry out his or her
19responsibilities.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.
