SYNOPSIS AS INTRODUCED:
 
730 ILCS 140/3  from Ch. 38, par. 1583

    Amends the Private Correctional Facility Moratorium Act. Provides that the Department of Corrections, the Department of Juvenile Justice, or a sheriff may not contract with private parties for the provision of nursing services in correctional facilities. Effective immediately.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Private Correctional Facility Moratorium
5Act is amended by changing Section 3 as follows:
 
6    (730 ILCS 140/3)  (from Ch. 38, par. 1583)
7    Sec. 3. Certain contracts prohibited. After the effective
8date of this Act, the State, any unit of local government, or a
9county sheriff, shall not contract with a private contractor or
10private vendor for the provision of services relating to the
11operation of a correctional facility or the incarceration of
12persons in the custody of, or the provision of nursing service
13within, the Department of Corrections, the Department of
14Juvenile Justice, or a sheriff; however, this Act does not
15apply to (1) State work release centers or juvenile residential
16facilities that provide separate care or special treatment
17operated in whole or part by private contractors or (2) unless
18otherwise provided in this Section, contracts for ancillary
19services, including medical services, educational services,
20repair and maintenance contracts, or other services not
21directly related to the ownership, management or operation of
22security services in a correctional facility.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
