1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Park District Code is amended by changing
5Section 2-2.1 as follows:
 
6    (70 ILCS 1205/2-2.1)  (from Ch. 105, par. 2-2.1)
7    Sec. 2-2.1. (a) When 2 or more park districts are situated
8entirely within the corporate limits of the same municipality,
9a park district coterminous with such municipality may be
10organized in the manner hereinafter provided, and, when so
11organized, shall supersede the park districts previously
12existing within the limits of the municipality. The petition to
13organize such a park district shall comply with the
14requirements of Section 2-2, but must be signed by not less
15than 100 legal voters residing in each of the existing park
16districts and, if the municipality includes territory not
17included within any existing park district, by at least 100
18legal voters residing in such territory or by at least 10% of
19the legal voters residing in such territory, whichever is less.
20The petition shall also state whether the proposed district
21shall have 5 elected commissioners or 7 appointed
22commissioners. If the proposed district shall have 7 appointed
23commissioners, the chief executive officer of the

1municipality, with the advice and consent of the corporate
2authorities, shall appoint the commissioners. The initial
3appointed commissioners shall serve terms determined by lot as
4follows: 2 for terms of 2 years, 2 for terms of 4 years, and 3
5for terms of 6 years. Thereafter, appointed commissioners shall
6serve for terms of 6 years. A vacancy in the office of
7appointed commissioner shall be filled for the unexpired term
8in the same manner as an original appointment. "Municipality"
9as used in this Section means a city, village or incorporated
10town.
11    (b) (Blank). When 2 or more municipalities, one of which
12having a population of less than 500, are situated within a
13park district, the park district may be reorganized into 2 new
14park districts, one of which shall be coterminous with the
15municipality having a population of less than 500, and one of
16which shall be coterminous with the remaining territory of the
17park district. A petition to reorganize such park district
18shall comply with the requirements of Section 2-2, but must be
19signed by at least 100 legal voters residing in the district to
20be reorganized. Title and possession of all real property and
21permanently located personal property of the district to be
22reorganized shall vest in the new district in which the
23property is located. Each new district shall succeed to its
24proportionate share of the bonded indebtedness of the
25reorganized district, to be determined according to the value,
26as equalized and assessed by the Department of Revenue, of all

1taxable property in each new district. Title and possession to
2all other property of the district as well as all other rights
3and obligations of the district shall be equitably distributed
4and apportioned between the 2 districts, as determined by the
5governing boards of both park districts. In the event that no
6agreement can be reached, the court in which the petition was
7filed to organize the new districts shall make the
8determination. All monies of the district on hand and all
9monies received from taxes levied before the creation of the 2
10new districts shall be paid on a pro rata basis to each new
11district according to the value, as equalized and assessed by
12the Department of Revenue, of all taxable property in each new
13district. This subsection (b) shall be effective only until
14January 1, 1987.
15    (c) (Blank). "Municipality" as used in this Section means a
16city, village or incorporated town.
