SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/1-167 new

     Amends the General Provisions Article of the Illinois Pension Code. Provides that if a person who first becomes a member or participant of a retirement system or pension fund under the Code on or after January 1, 2018 (i) is receiving a retirement annuity or retirement pension under that system or fund and (ii) becomes a member or participant under any other system or fund created by the Code based on full-time employment, then that retirement annuity or retirement pension shall be suspended during that employment. Upon termination of that employment, the person's retirement annuity or retirement pension payments shall resume and may be recalculated if recalculation is provided for under the applicable Article of the Code. Effective immediately.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by adding
5Section 1-167 as follows:
 
6    (40 ILCS 5/1-167 new)
7    Sec. 1-167. Pension suspended upon return to employment.
8Notwithstanding any other provision of law or provision
9otherwise establishing or regulating a pension fund or
10retirement system under this Code, if a person who first
11becomes a member or participant of a retirement system or
12pension fund under this Code on or after January 1, 2018 (i) is
13receiving a retirement annuity or retirement pension under that
14system or fund and (ii) becomes a member or participant under
15any other system or fund created by this Code based on
16full-time employment, then that retirement annuity or
17retirement pension shall be suspended during that employment.
18Upon termination of that employment, the person's retirement
19annuity or retirement pension payments shall resume and may be
20recalculated if recalculation is provided for under the
21applicable Article of this Code.
