SYNOPSIS AS INTRODUCED:

65 ILCS 5/11-20-17 new

Amends the Illinois Municipal Code. Provides that the City of Chicago shall waive all permit, registration, licensing, or operating fees for any vehicles that are specifically designed, constructed, modified and equipped, or used for the retail sale of food that operates in a food desert. Defines "food desert" as meaning the United States Department of Agriculture's classification of a low-income census tract where either a substantial number or share of residents has low access to a supermarket or large grocery store. Limits home rule powers.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by adding Section 11-20-17 as follows:

(65 ILCS 5/11-20-17 new)

Sec. 11-20-17. Vehicles for the retail sale of food in food deserts.

(a) For purposes of this Section, "food desert" means the United States Department of Agriculture's classification of a low-income census tract where either a substantial number or share of residents has low access to a supermarket or large grocery store.

(b) The City of Chicago shall waive all permit, registration, licensing, or operating fees for any vehicles that are specifically designed, constructed, modified and equipped, or used for the retail sale of food that operates in a food desert.

(c) The City of Chicago may not regulate vehicles in a manner inconsistent with this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.
