SYNOPSIS AS INTRODUCED:

625 ILCS 5/3-804.01

    Amends the Illinois Vehicle Code. Provides that an owner of an antique moped may register the moped for a fee not to exceed $13 for a 2-year antique plate. Provides that in addition to the appropriate registration or renewal fees, an owner of an antique moped may also register the moped as an expanded-use antique moped for a registration and renewal fee of $45 per year. Defines "antique moped".

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 3-804 and 3-804.01 and by adding Section 1-102.03 as
6follows:
 
7    (625 ILCS 5/1-102.03 new)
8    Sec. 1-102.03. Antique moped. A motor-driven cycle, with or
9without optional power derived from manually operated pedals,
10that is more than 25 years of age, or a bona fide replica
11thereof, whose speed attainable in one mile is at least 20 mph
12but not greater than 30 mph, and is equipped with a motor that
13produces 2 brake horsepower or less. If an internal combustion
14engine is used, the displacement shall not exceed 50 cubic
15centimeter displacement and the power drive system shall not
16require the operator to shift gears.

18    Sec. 3-804. Antique vehicles; antique mopeds.
19    (a) The owner of an antique vehicle or antique moped may
20register such vehicle or moped for a fee not to exceed $13 for
21a 2-year antique plate. The application for registration must
22be accompanied by an affirmation of the owner that such vehicle

1or moped will be driven on the highway only for the purpose of
2going to and returning from an antique auto show or an
3exhibition, or for servicing or demonstration and also
4affirming that the mechanical condition, physical condition,
5brakes, lights, glass and appearance of such vehicle or moped
6is the same or as safe as originally equipped. The Secretary
7may, in his discretion prescribe that antique vehicle or
8antique moped plates be issued for a definite or an indefinite
9term, such term to correspond to the term of registration
10plates issued generally, as provided in Section 3-414.1. In no
11event may the registration fee for antique vehicles or antique
12mopeds exceed $6 per registration year. Any person requesting
13antique plates under this Section may also apply to have vanity
14or personalized plates as provided under Section 3-405.1.
15    (b) Any person who is the registered owner of an antique
16vehicle or antique moped may display a historical license plate
17from or representing the model year of the vehicle or moped,
18furnished by such person, in lieu of the current and valid
19Illinois antique vehicle or antique moped plates issued
20thereto, provided that valid and current Illinois antique
21vehicle or antique moped plates and registration card issued to
22such antique vehicle or antique moped are simultaneously
23carried within such vehicle or moped and are available for
24inspection.

2    Sec. 3-804.01. Expanded-use antique vehicles and
3expanded-use antique mopeds.
4    (a) The owner of a motor vehicle or moped that is more than
525 years of age or a bona fide replica thereof may register the
6vehicle or moped as an expanded-use antique vehicle or
7expanded-use antique moped. In addition to the appropriate
8registration and renewal fees, the fee for expanded-use antique
9vehicle or expanded-use antique moped registration and renewal
10shall be $45 per year. The application for registration must be
11accompanied by an affirmation of the owner that:
12        (1) from January 1 through March 31 and from November 1
13    through December 31, the vehicle or moped will be driven on
14    the highways only for the purpose of going to and returning
15    from an antique auto show or an exhibition, or for
16    servicing or demonstration; and
17        (2) the mechanical condition, physical condition,
18    brakes, lights, glass, and appearance of such vehicle is
19    the same or as safe as originally equipped.
20    From April 1 through October 31, a vehicle or moped
21registered as an expanded-use antique vehicle or expanded-use
22antique moped may be driven on the highways without being
23subject to the restrictions set forth in subdivision (1). The
24Secretary may prescribe, in the Secretary's discretion, that
25expanded-use antique vehicle or expanded-use antique moped
26plates be issued for a definite or an indefinite term, such

1term to correspond to the term of registration plates issued
2generally, as provided in Section 3-414.1. Any person
3requesting expanded-use antique vehicle or expanded-use
4antique moped plates under this Section may also apply to have
5vanity or personalized plates as provided under Section
63-405.1.
7    (b) Any person who is the registered owner of an
8expanded-use antique vehicle or expanded-use antique moped may
9display a historical license plate from or representing the
10model year of the vehicle or moped, furnished by such person,
11in lieu of the current and valid Illinois expanded-use antique
12vehicle or expanded-use antique moped plates issued thereto,
13provided that the valid and current Illinois expanded-use
14antique vehicle or expanded-use antique moped plates and
15registration card issued to the expanded-use antique vehicle or
16expanded-use antique moped are simultaneously carried within
17the vehicle and are available for inspection.
18    (c) The Secretary may credit a pro-rated portion of a fee
19previously paid for an antique vehicle or antique moped
20registration under Section 3-804 to an owner who applies to
21have that vehicle or moped registered as an expanded-use
22antique vehicle or expanded-use antique moped instead of an
23antique vehicle or antique moped.
