SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1303  from Ch. 95 1/2, par. 11-1303

    Amends the Illinois Vehicle Code. Provides that in a municipality with a population of 1,000,000 or more inhabitants, it shall be an affirmative defense to the offense of parking in violation of an official sign prohibiting parking if the official sign is prohibiting parking for a construction zone or public works project zone and at the time of the violation there is no work being conducted in the construction zone or public works project zone.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-1303 as follows:
 
6    (625 ILCS 5/11-1303)  (from Ch. 95 1/2, par. 11-1303)
7    Sec. 11-1303. Stopping, standing or parking prohibited in
8specified places.
9    (a) Except when necessary to avoid conflict with other
10traffic, or in compliance with law or the directions of a
11police officer or official traffic-control device, no person
12shall:
13        1. Stop, stand or park a vehicle:
14            a. On the roadway side of any vehicle stopped or
15        parked at the edge or curb of a street;
16            b. On a sidewalk;
17            c. Within an intersection;
18            d. On a crosswalk;
19            e. Between a safety zone and the adjacent curb or
20        within 30 feet of points on the curb immediately
21        opposite the ends of a safety zone, unless a different
22        length is indicated by signs or markings;
23            f. Alongside or opposite any street excavation or

1        obstruction when stopping, standing or parking would
2        obstruct traffic;
3            g. Upon any bridge or other elevated structure upon
4        a highway or within a highway tunnel;
5            h. On any railroad tracks. A violation of any part
6        of this subparagraph h. shall result in a mandatory
7        fine of $500 or 50 hours of community service.
8            i. At any place where official signs prohibit
9        stopping;
10            j. On any controlled-access highway;
11            k. In the area between roadways of a divided
12        highway, including crossovers;
13            l. In a public parking area if the vehicle does not
14        display a current annual registration sticker or
15        current temporary permit pending registration.
16        2. Stand or park a vehicle, whether occupied or not,
17    except momentarily to pick up or discharge passengers:
18            a. In front of a public or private driveway;
19            b. Within 15 feet of a fire hydrant;
20            c. Within 20 feet of a crosswalk at an
21        intersection;
22            d. Within 30 feet upon the approach to any flashing
23        signal, stop sign, yield sign, or traffic control
24        signal located at the side of a roadway;
25            e. Within 20 feet of the driveway entrance to any
26        fire station and on the side of a street opposite the

1        entrance to any fire station within 75 feet of such
2        entrance (when properly sign-posted);
3            f. At any place where official signs prohibit
4        standing.
5        3. Park a vehicle, whether occupied or not, except
6    temporarily for the purpose of and while actually engaged
7    in loading or unloading property or passengers:
8            a. Within 50 feet of the nearest rail of a railroad
9        crossing;
10            b. At any place where official signs prohibit
11        parking.
12    (a-5) In a municipality with a population of 1,000,000 or
13more inhabitants, it shall be an affirmative defense to an
14offense under subparagraph b of paragraph 3 of subsection (a)
15of this Section if the official sign is prohibiting parking for
16a construction zone or public works project zone and at the
17time of the violation there is no work being conducted in the
18construction zone or public works project zone.
19    (b) No person shall move a vehicle not lawfully under his
20control into any such prohibited area or away from a curb such
21distance as is unlawful.
