SYNOPSIS AS INTRODUCED:

New Act
10000SB0031enr, Secs. 1 through 20 rep.

Creates the Sanctuary City Sanction Act. Provides that if a unit of local government has in place any policy that limits or restricts compliance with immigration detainers issued by the Secretary of Homeland Security or otherwise does not comply with an immigration detainer, all grants of State funds that the unit of local government would otherwise receive will not be distributed to the unit of local government until any policy that limits or restricts compliance with an immigration detainer is abolished and compliance with immigration detainers is demonstrated by the unit of local government. Defines terms. Repeals the Illinois TRUST Act. Effective immediately.

A BILL FOR

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Sanctuary City Sanction Act.

Section 5. Definitions. As used in this Act:

"Immigration detainer" means any order or request relating to undocumented persons whose immigration status is in question by the Secretary of Homeland Security to a unit of local government official:

(1) to temporarily hold a person in the custody of a unit of local government until the person may be taken into federal custody;

(2) to transport the person for transfer to federal custody; or

(3) to notify the Secretary of Homeland Security prior to the release of such a person.

"State funds" includes, but is not limited to, a unit of local government's local share of the state income tax from the Local Government Distributive Fund, a unit of local government's local share of Corporate Personal Property Replacement Tax, and a unit of local government's local share of sales tax.

Section 10. Failure to comply with immigration detainers. Notwithstanding any other provision of law, if a unit of local government has in place any policy that limits or restricts compliance with immigration detainers or otherwise does not comply with an immigration detainer, all grants of State funds that the unit of local government would otherwise receive will not be distributed to that unit of local government until any policy that limits or restricts compliance with an immigration detainer is abolished and compliance with immigration detainers is demonstrated by the unit of local government.

Section 900. The Illinois TRUST Act is repealed.

Section 999. Effective date. This Act takes effect upon becoming law.
