SYNOPSIS AS INTRODUCED:

20 ILCS 2705/2705-583 new

Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Provides that in the event a physician of the Department of Transportation uses guidance standards that are in violation of Public Law 113-45 with regards to sleep apnea screening and testing of a potential employee of the Department when the employee may be operating a commercial motor vehicle, the physician shall be subject to a civil penalty of no more than $5,000 and the Department shall revoke his or her physician certificate. Effective immediately.

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Department of Transportation Law of the Civil Administrative Code of Illinois is amended by adding Section 2705-583 as follows:

Sec. 2705-583. Department physicians; sleep apnea screening. In the event a physician of the Department uses guidance standards that are in violation of Public Law 113-45, approved October 15, 2013, with regards to sleep apnea screening and testing of a potential employee of the Department when the employee may be operating a commercial motor vehicle, the physician shall be subject to a civil penalty of no more than $5,000 and the Department shall revoke his or her physician certificate.

Section 99. Effective date. This Act takes effect upon becoming law.
