SYNOPSIS AS INTRODUCED:

Amends the Swimming Facility Act and Swimming Pool Safety Act. Provides that "swimming pool" does not include therapeutic pools used in physical therapy programs operated by medical facilities licensed by the Department of Public Health or operated by physical therapists licensed under the Illinois Physical Therapy Act.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Swimming Facility Act is amended by changing Section 3.01 as follows:

Sec. 3.01. Swimming pool. "Swimming pool" means any artificial basin of water which is modified, improved, constructed or installed for the purpose of public swimming, wading, floating, or diving, and includes: pools for community use, pools at apartments, condominiums, and other groups or associations having 5 or more living units, clubs, churches, camps, schools, institutions, Y.M.C.A.'s, Y.W.C.A.'s, parks, recreational areas, motels, hotels, health clubs, golf and country clubs, and other commercial establishments. It does not include: (1) pools at private single-family residences intended only for the use of the owner and guests; or (2) therapeutic pools used in physical therapy programs operated by medical facilities licensed by the Department of Public Health or operated by physical therapists licensed under the Illinois Physical Therapy Act.

Section 10. The Swimming Pool Safety Act is amended by changing Section 1 as follows:

Sec. 1. As used in this Act:

"Swimming pool" means any artificial basin of water which is modified, improved, constructed or installed for the purpose of public swimming, and includes: pools for community use, pools at apartments, condominiums, and other groups or associations having 5 or more living units, clubs, churches, camps, schools, institutions, Y.M.C.A.s, Y.W.C.A.s, parks, recreational areas, motels, hotels and other commercial establishments. It does not include: (1) pools at private residences intended only for the use of the owner and guests; or (2) therapeutic pools used in physical therapy programs operated by medical facilities licensed by the Department of Public Health or operated by physical therapists licensed under the Illinois Physical Therapy Act.

"Person" means any individual, group of individuals, association, trust, partnership, corporation, person doing business under an assumed name, county, municipality, the State of Illinois, or any political subdivision or department thereof, or any other entity.

"Life jacket" means a life jacket, life vest or any other flotation device designed to be worn about the body to assist in maintaining buoyancy in water.
