SYNOPSIS AS INTRODUCED:
 
230 ILCS 40/79.5 new

    Amends the Video Gaming Act. Provides that the Illinois Gaming Board shall establish a policy and standards for compliance operations to investigate whether a licensed establishment, licensed fraternal establishment, licensed veterans establishment, or a licensed truck stop establishment is permitting any person under the age of 21 years to use or play a video gaming terminal in violation of the Act or furnishing alcoholic liquor to persons under 21 years of age in violation of the Liquor Control Act. Contains provisions concerning the content of the policy and standards. Provides that a licensed establishment, licensed fraternal establishment, licensed veterans establishment, or licensed truck stop establishment that is the subject of an enforcement action under these provisions and is found, pursuant to the enforcement action, to be in compliance with the Act shall be notified by the Board that no violation was found within 30 days after the finding. Effective immediately.

1    AN ACT concerning gaming.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Video Gaming Act is amended by adding
5Section 79.5 as follows:
 
6    (230 ILCS 40/79.5 new)
7    Sec. 79.5. Enforcement actions. The Board shall establish
8a policy and standards for compliance operations to investigate
9whether a licensed establishment, licensed fraternal
10establishment, licensed veterans establishment, or a licensed
11truck stop establishment is: (1) permitting any person under
12the age of 21 years to use or play a video gaming terminal in
13violation of this Act; or (2) furnishing alcoholic liquor to
14persons under 21 years of age in violation of the Liquor
15Control Act.
16    The policy and standards for compliance operations shall be
17similar to the model policy and guidelines for the operation of
18alcohol and tobacco compliance checks by local law enforcement
19officers. The policy and standards for compliance checks shall
20include, but not be limited to, priority of operations based
21upon a review of police reports and citizen complaints of
22underage gaming, the age and appearance of the underage
23individual acting under the direction of an investigator of the

1Board, limitations of compliance checks during peak hours of
2licensee operations, and the establishment of a reasonable
3amount of time for a violation to have taken place.
4    A licensed establishment, licensed fraternal
5establishment, licensed veterans establishment, or licensed
6truck stop establishment that is the subject of an enforcement
7action under this Section and is found, pursuant to the
8enforcement action, to be in compliance with this Act shall be
9notified by the Board that no violation was found within 30
10days after the finding.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
