SYNOPSIS AS INTRODUCED:

105 ILCS 5/34-18.60 new

    Amends the School Code. Defines "temporary door locking device". Provides that, upon submitting an application to the regional superintendent of schools, a school district may obtain a temporary door locking device for use on a school building. Specifies application requirements. Provides that an approved temporary door locking device shall be used only (i) by a staff member of a school district trained under the provision, (ii) during an emergency situation that threatens the health and safety of students and staff members or during an active shooter drill, and (iii) when law enforcement officials and the local fire department have been notified prior to use of the device. Provides that the device shall be engaged for a finite period of time in accordance with the school district's school safety plan adopted under the School Safety Drill Act. Provides that a school district with an approved temporary door locking device shall conduct an in-service training program for staff members on the proper use of the device.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Sections
510-20.67 and 34-18.60 as follows:
 
6    (105 ILCS 5/10-20.67 new)
7    Sec. 10-20.67. Temporary door locking device.
8    (a) In this Section, "temporary door locking device" means
9an assembly of parts intended for use by a trained school staff
10member in a school building for the purpose of preventing both
11ingress and egress through a door of the building.
12    (b) Upon submitting an application to the regional
13superintendent of schools in a form and manner prescribed by
14the regional superintendent, a school district may obtain a
15temporary door locking device for use on a school building. The
16application shall include, but is not limited to:
17        (1) evidence of a properly adopted and filed school
18    safety plan under the School Safety Drill Act;
19        (2) a statement confirming that law enforcement
20    officials and the local fire department have been notified
21    about the temporary door locking device;
22        (3) a description of the temporary door locking device
23    the school district proposes to acquire; and

1        (4) a statement confirming that any bolts, stops,
2    brackets, or pins employed by the temporary door locking
3    device do not affect the fire rating of a fire door
4    assembly.
5    Upon receiving an application under this subsection (b), a
6regional superintendent shall evaluate the school district's
7proposed temporary door locking device to ensure compliance
8with subsection (c) of this Section. The regional
9superintendent may consult a local fire department when
10reviewing the application if the consultation would not result
11in the undue delay of approving or disapproving the
12application.
13    If a regional superintendent approves an application under
14this subsection (b), the approval shall be noted on the school
15building's certificate of occupancy. If a regional
16superintendent disapproves an application, he or she shall
17notify the school district of the decision and the reasons for
18the decision.
19    (c) An approved temporary door locking device shall be used
20only (i) by a staff member of a school district trained under
21subsection (d) of this Section, (ii) during an emergency
22situation that threatens the health and safety of students and
23staff members or during an active shooter drill, and (iii) when
24law enforcement officials and the local fire department have
25been notified prior to use of the device. The device shall be
26engaged for a finite period of time in accordance with the

1school district's school safety plan adopted under the School
2Safety Drill Act. The device may not be permanently mounted to
3a door; however, assembly items such as bolts, stops, brackets,
4or pins that do not prevent ingress and egress through the door
5may be permanently mounted if they do not affect the fire
6rating of a fire door assembly. After it is engaged, the
7removal of the device must not require more than one operation;
8however, 2 operations may be permitted when the school building
9is equipped with an automatic sprinkler system.
10    (d) A school district with an approved temporary door
11locking device shall conduct an in-service training program for
12staff members on the proper use of the device. The school
13district shall keep a file verifying the staff members who have
14completed the program and shall provide the file to the local
15fire department upon request.

17    Sec. 34-18.60. Temporary door locking device.
18    (a) In this Section, "temporary door locking device" means
19an assembly of parts intended for use by a trained school staff

23Education in a form and manner prescribed by the State Board,
24the school district may obtain a temporary door locking device

1but is not limited to:
2        (1) evidence of a properly adopted and filed school
3    safety plan under the School Safety Drill Act;
