    Amends the Developmental Disability and Mental Disability Services Act. Makes a technical change in a Section concerning an application and the amount of services to be provided.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Developmental Disability and Mental
5Disability Services Act is amended by changing Section 2-6 as
6follows:
 
7    (405 ILCS 80/2-6)  (from Ch. 91 1/2, par. 1802-6)
8    Sec. 2-6. An application for the the Program shall be
9submitted to the Department by the adult with a mental
10disability or, if the adult with a mental disability requires a
11guardian, by his or her legal guardian. If the application for
12participation in the Program is approved by the Department and
13the adult with a mental disability is eligible to receive
14services under this Article, the adult with a mental disability
15shall be made aware of the availability of a community support
16team and shall be offered case management services. The amount
17of the home-based services provided by the Department in any
18month shall be determined by the service plan of the adult with
19a mental disability, but in no case shall it be more than
20either:
21        (a) three hundred percent of the monthly federal
22    Supplemental Security Income payment for an individual
23    residing alone if the adult with a mental disability is not

1    enrolled in a special education program by a local
2    education agency, or
3        (b) two hundred percent of the monthly Supplemental
4    Security Income payment for an individual residing alone if
5    the adult with a mental disability is enrolled in a special
6    education program by a local education agency.
7    Upon approval of the Department, all or part of the monthly
8amount approved for home-based services to participating
9adults may be used as a one-time or continuing payment to the
10eligible adult or the adult's parent or guardian to pay for
11specified tangible items that are directly related to meeting
12basic needs related to the person's mental disabilities.
13    Tangible items include, but are not limited to: adaptive
14equipment, medication not covered by third-party payments,
15nutritional supplements, and residential modifications.
