SYNOPSIS AS INTRODUCED:

    Amends the State Property Control Act. Provides that all proceeds received by the Department of Central Management Services under the Act from the sale of vehicles operated by the Secretary of State Department of Police, except for a $500 handling fee to be retained by the Department for each vehicle sold, shall be deposited into the Secretary of State Police Services Fund for, subject to appropriation, the maintenance and operation of vehicles for the Department of Police. Amends the Illinois Vehicle Code. Provides that if the Secretary of State Department of Police is required to inspect, create, and stamp a vehicle identification number on a specially constructed, reconstructed, or foreign vehicle, then the owner of the vehicle shall pay a $50 service fee to be deposited into the Secretary of State Police Services Fund to assist in covering the costs of inspecting and processing the vehicle. Provides that if, upon notification by a law enforcement agency that a vehicle does not have valid Illinois registration or reciprocal foreign registration, the Secretary of State Department of Police is required to issue valid Illinois registration, then a $125 service fee shall be collected in addition to any other required registration fees. The $125 service fee shall be deposited into the Secretary of State Police Services Fund. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Property Control Act is amended by
5changing Section 7b as follows:
 
6    (30 ILCS 605/7b)
7    Sec. 7b. Maintenance and operation of State Police and
8Secretary of State Police vehicles.
9    (a) All proceeds received by the Department of Central
10Management Services under this Act from the sale of vehicles
11operated by the Department of State Police, except for a $500
12handling fee to be retained by the Department of Central
13Management Services for each vehicle sold, shall be deposited
14into the State Police Vehicle Maintenance Fund. However, in
15lieu of the $500 handling fee under this subsection (a) as
16provided by this paragraph, the Department of Central
17Management Services shall retain all proceeds from the sale of
18any vehicle for which $500 or a lesser amount is collected.
19    The State Police Vehicle Maintenance Fund is created as a
20special fund in the State treasury. All moneys in the State
21Police Vehicle Maintenance Fund, subject to appropriation,
22shall be used by the Department of State Police for the
23maintenance and operation of vehicles for that Department.

1    (b) All proceeds received by the Department of Central
2Management Services under this Act from the sale of vehicles
3operated by the Secretary of State Department of Police, except

14    Section 10. The Illinois Vehicle Code is amended by
15changing Sections 3-406 and 3-813 as follows:

17    Sec. 3-406. Application for specially constructed,
18reconstructed, custom, street rod, foreign vehicles, or glider
19kits.
20    (a) In the event the vehicle to be registered is a
21specially constructed, reconstructed or foreign vehicle, such
22fact shall be stated in the application and with reference to
23every foreign vehicle which has been registered heretofore
24outside of this State the owner shall surrender to the

1Secretary of State all registration plates, registration cards
2or other evidence of such foreign registration as may be in his
3possession or under his control except as provided in
4subdivision (b) hereof.
5    (b) Where in the course of interstate operation of a
6vehicle registered in another State, it is desirable to retain
7registration of said vehicle in such other State, such
8applicant need not surrender but shall submit for inspection
9said evidences of such foreign registration and the Secretary
10of State upon a proper showing shall register said vehicle in
11this State but shall not issue a certificate of title for such
12vehicle.
13    (c) In the event the applicant seeks to have the vehicle
14registered as a custom vehicle or street rod, that fact must be
15stated in the application. Prior to registration, custom
16vehicles or street rods must be inspected by the Secretary of
17State Department of Police. Upon successful completion of the
18inspection, the vehicle may be registered in the following
19manner. The make of the vehicle shall be listed as the make of
20the actual vehicle or the make it is designed to resemble
21(e.g., Ford or Chevrolet); the model of the vehicle shall be
22listed as custom vehicle or street rod; and the year of the
23vehicle shall be listed as the year the actual vehicle was
24manufactured or the year it is designed to resemble.
25    (d) In the event the applicant seeks to have the vehicle
26registered as a glider kit, that fact must be stated in the

1application. Each glider kit sought to be registered shall be
2inspected by the Secretary of State Department of Police who
3shall verify the chassis, cab, front axle, and other essential
4parts as acceptable. Upon successful completion of the
5inspection, the vehicle may be registered in the following
6manner: (1) the make of the vehicle shall be listed as the make
7of the chassis of the actual manufacturer; (2) the model of the
8vehicle shall be listed as glider kit; and (3) the year of the
9vehicle shall be listed as the year presented on the
10manufacturer's certificate of origin for the chassis, unless no
11year is presented, then it shall be listed as the year the
12application is received.
13    (e) If the Secretary of State Department of Police is
14required to inspect, create, and stamp a vehicle identification
15number on a specially constructed, reconstructed, or foreign
16vehicle, then the owner of the vehicle shall pay a $50 service
17fee to be deposited into the Secretary of State Police Services
18Fund to assist in covering the costs of inspecting and
19processing the vehicle.

22    Sec. 3-813. Vehicles of second division - Registration fee.
23Except as otherwise provided in this Code, all owners of
24vehicles of the second division which are designed, equipped or
25used for carrying freight, goods, wares, merchandise, or for

1use as living quarters; and all owners of vehicles of the first
2division which have been remodelled and are being used for such
3purposes; and all owners of motor vehicles operated as truck
4tractors to the weights of which are added to the gross weights
5of semitrailers with their maximum loads when drawn by such
6truck tractors; and all owners of vehicles of the second
7division which are used for carrying more than 10 persons,
8shall pay to the Secretary of State for each registration year,
9for the use of the public highways of this State, a
10registration fee of $10 for each such vehicle, which shall be
11collected as part of the flat weight tax assessed under Section
123-815 of this Code. A self-propelled vehicle operated as a
13truck tractor and one semitrailer or a combination of a truck
14tractor and semitrailer drawing a trailer or a semitrailer
15converted to a trailer through use of an auxiliary axle or any
16combination of apportioned vehicles shall be considered as one
17vehicle in computing the flat weight taxes under Section 3-815.
18    If, upon notification by a law enforcement agency that a
19vehicle does not have valid Illinois registration or reciprocal
20foreign registration, the Secretary of State Department of
21Police is required to issue valid Illinois registration along
22the highways of this State, then a $125 service fee shall be
23collected in addition to any other required registration fees.
24The $125 service fee shall be deposited into the Secretary of
25State Police Services Fund.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
