1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Regulatory Sunset Act is amended by changing
5Section 4.28 and adding Section 4.38 as follows:
 
6    (5 ILCS 80/4.28)
7    Sec. 4.28. Acts repealed on January 1, 2018. The following
8Acts are repealed on January 1, 2018:
9    The Illinois Petroleum Education and Marketing Act.
10    The Podiatric Medical Practice Act of 1987.
11    The Acupuncture Practice Act.
12    The Illinois Speech-Language Pathology and Audiology
13Practice Act.
14    The Interpreter for the Deaf Licensure Act of 2007.
15    The Nurse Practice Act.
16    The Clinical Social Work and Social Work Practice Act.
17    The Pharmacy Practice Act.
18    The Home Medical Equipment and Services Provider License
19Act.
20    The Marriage and Family Therapy Licensing Act.
21    The Nursing Home Administrators Licensing and Disciplinary
22Act.
23    The Physician Assistant Practice Act of 1987.

7    Sec. 4.38. Act repealed on January 1, 2028. The following
8Act is repealed on January 1, 2028:
9    The Illinois Petroleum Education and Marketing Act.
 
10    Section 10. The Illinois Petroleum Education and Marketing
11Act is amended by changing Sections 10, 15, and 45 as follows:

14    Sec. 10. Illinois Petroleum Resources Board.
15    (a) There is hereby created until January 1, 2018, the
16Illinois Petroleum Resources Board, which shall be subject to
17the provisions of the Regulatory Sunset Act. The purpose of the
18Board is to coordinate a program designed to demonstrate to the
19general public the importance of the Illinois oil and gas
20exploration and production industry, to encourage the wise and
21efficient use of energy, to promote environmentally sound
22production methods and technologies, to develop existing
23supplies of State oil and gas resources, and to support

1research and educational activities concerning the oil and gas
2exploration and production industry, and to support oilfield
3environmental remediation and restoration activities.
4    (b) The Board shall be composed of 12 members to be
5appointed as follows:
6        (1) Through December 31, 2006, the Governor shall make
7    appointments from a list of names submitted by qualified
8    producer associations, of which 10 shall be oil and gas
9    producers.
10        (2) Beginning January 1, 2007, all appointments shall
11    be made by the qualified producer associations.
12    (c) A member of the Board shall:
13        (1) be at least 25 years of age;
14        (2) be a resident of the State of Illinois; and
15        (3) have at least 5 years of active experience in the
16    oil industry.
17    (d) Members shall serve for a term of 3 years, except that
18of the initial appointments, 4 members shall serve for one
19year, 4 members for 2 years, and 4 members for 3 years.
20    (e) Vacancies shall be filled for the unexpired term of
21office in the same manner as the original appointment.
22    (f) The Board shall, at its first meeting, elect one of its
23members as chairperson, who shall preside over meetings of the
24Board and perform other duties that may be required by the
25Board. The first meeting of the Board shall be called by the
26Governor.

1    (g) No member of the Board shall receive a salary or
2reimbursement for duties performed as a member of the Board,
3except that members are eligible to receive reimbursement for
4travel expenses incurred in the performance of Board duties.

8    Sec. 15. Board powers and duties. The Board shall have the
9following powers and duties:
10        (1) To administer and enforce the provisions of this
11    Act.
12        (2) To establish an office for the Board within the
13    State of Illinois.
14        (3) To elect a chairperson and any other officers that
15    may be necessary to direct the operations of the Board.
16        (4) To employ personnel as shall be deemed necessary to
17    carry out the purpose and provisions of this Act and to
18    prescribe their duties and fix their compensation.
19        (5) To receive and administer all assessments,
20    donations, grants, contributions, and gifts received by
21    the Board pursuant to this Act and to deposit them into
22    accounts maintained by the Board.
23        (6) To annually establish priorities and approve a
24    prepared budget consistent with estimated resources.
25        (7) To adopt rules as it deems necessary to carry out

1    the provisions of this Act.
2        (8) To enter into contracts or agreements for studies,
3    research projects, experimental work, supplies, or other
4    services to carry out the purposes of this Act and to incur
5    those expenses necessary to carry out those purposes. A
6    contract or agreement entered into under this item shall
7    provide that:
8            (A) the person entering the contract or agreement
9        on behalf of the Board shall develop and submit to the
10        Board a plan or project together with a budget that
11        shows estimated costs to be incurred for the plan or
12        project; and
13            (B) the person entering the contract or agreement
14        shall keep accurate records of all of its transactions,
15        account for funds received and expended, and make
16        periodic reports to the Board of activities conducted
17        and other reports that the Board may require.
18        (9) To keep accurate records of all financial
19    transactions performed pursuant to this Act. These records
20    shall be audited annually by an independent auditor who is
21    a certified public accountant and has been selected by the
22    Board, and an annual report shall be compiled and made
23    available to any interest owner and filed with the
24    Department within 60 days after the close of the Board's
25    fiscal year.
26        (10) To cooperate with any private, local, state, or

1    national commission, organization, agency, or group and to
2    make contracts and agreements for joint programs
3    beneficial to the oil and gas industry.
4        (11) To accept donations, grants, contributions, and
5    gifts from any public or private source and deposit them
6    into accounts maintained by the Board.
7        (12) To keep an accurate record of all assessments
8    collected.
9        (13) To enter into voluntary agreements with the
10    Department to support oilfield environmental remediation
11    and restoration activities.

15    Sec. 45. Use of funds.
16    (a) All interest earned on moneys received by the Board
17shall be the property of the Board.
18    (a-5) The Board may expend funds only as provided for by
19law.
20    (b) The Board shall not utilize any funds collected under
21Section 30 of this Act for the purpose of influencing
22government action or policy, with the exception of recommending
23amendments to this Act.
24    (c) None of the moneys collected under Section 30 and not
25refunded under Section 35 of this Act shall be used for travel

1expenses of any member of the Illinois General Assembly.

3    Section 99. Effective date. This Act takes effect upon
4becoming law.
