 1        AN ACT in relation to public employee benefits.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Illinois  Pension  Code  is  amended  by
 5    adding Section 6-141.2 as follows:

 6        (40 ILCS 5/6-141.2 new)
 7        Sec.   6-141.2.   Minimum  annuity  for  certain  widows.
 8    Notwithstanding the other provisions  of  this  Article,  the
 9    widow's annuity payable to the widow of a fireman who dies on
10    or  after  July 1, 1997 while an active fireman with at least
11    10 years of creditable service shall be no less than  50%  of
12    the  retirement  annuity that the deceased fireman would have
13    been eligible to receive if he had attained  age  50  and  20
14    years  of  service on the day before his death and retired on
15    that day.  In the case of a widow's annuity that  is  payable
16    on  the  effective  date  of  this amendatory Act of the 93rd
17    General Assembly, the increase provided by this  Section,  if
18    any,  shall begin to accrue on the first annuity payment date
19    following that effective date.

20        Section 90.  The State Mandates Act is amended by  adding
21    Section 8.27 as follows:

22        (30 ILCS 805/8.27 new)
23        Sec.  8.27.  Exempt  mandate.  Notwithstanding Sections 6
24    and 8 of this Act, no reimbursement by the State is  required
25    for  the  implementation  of  any  mandate  created  by  this
26    amendatory Act of the 93rd General Assembly.

27        Section  99.  Effective date.  This Act takes effect upon
28    becoming law.
