 1                    AMENDMENT TO HOUSE BILL 1350

 2        AMENDMENT NO.     .  Amend House Bill 1350 as follows:
 3    on page  1,  by  replacing  lines  28  through  31  with  the
 4    following:
 5    "activity  is a Class 3 felony for a first offense, a Class 1
 6    felony for a second offense, and a Class X felony for a third
 7    or subsequent offense if the defendant is under 18  years  of
 8    age at the time of the offense.  If the defendant is 18 years
 9    of  age  or older at the time of the offense, the penalty for
10    violating this subsection (b) is a Class 2 felony for a first
11    offense, a Class 1 felony for a second offense, and a Class X
12    felony for a third or subsequent offense.".
