 1        AN ACT concerning procurement.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois Procurement Code is  amended  by
 5    adding Section 40-45 as follows:

 6        (30 ILCS 500/40-45 new)
 7        Sec.  40-45.  Nonperformance of terms for improvements. A
 8    lease  may  provide  for  a  percentage  reduction  in  lease
 9    payments when the lessor fails to make improvements  required
10    by  the lease. The reduction in payments shall continue until
11    the lessor complies with the lease. The using agency and  the
12    Department  of  Central  Management Services must certify the
13    improvements as acceptable before the reduction  in  payments
14    ceases.
