SYNOPSIS AS INTRODUCED:
 
725 ILCS 5/112-3   from Ch. 38, par. 112-3

    Amends the Code of Criminal Procedure of 1963. Provides that in all counties with a population of less than 1,000,000 no more than 2 Grand Juries (instead of 1 Grand Jury in counties of 225,000 or less) shall sit at the same time.

1     AN ACT concerning grand juries.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Code of Criminal Procedure of 1963 is
5 amended by changing Section 112-3 as follows:
 
6     (725 ILCS 5/112-3)  (from Ch. 38, par. 112-3)
7     Sec. 112-3. Duration of Grand Jury.
8     (a) In counties with a population in excess of 1,000,000 a
9 Grand Jury shall be convened, impaneled and sworn, and shall
10 commence the performance of its duties for an indeterminate
11 period, on the first Monday of each month. In such counties a
12 Grand Jury shall serve until discharged by the court, except
13 that no Grand Jury shall serve in excess of 18 months and not
14 more than 6 Grand Juries shall sit at the same time.
15     In counties with a population of in excess of 225,000 but
16 less than 1,000,000 a Grand Jury may be convened, empaneled,
17 and sworn and may sit at such times and for such periods as the
18 circuit court may order on its own motion or that of the
19 State's Attorney. No Grand Jury shall serve in excess of 18
20 months and not more than 2 Grand Juries shall sit at the same
21 time.
22     (b) (Blank). In all other counties the Grand Jury shall be
23 called and sit at such times and for such periods as the
24 circuit court may order on its own motion or that of the
25 State's Attorney; provided, that no Grand Jury shall sit for a
26 period in excess of 18 months and, provided further, that no
27 more than one Grand Jury shall sit at the same time.
28     (c) At any time for cause shown the court may excuse a
29 grand juror either temporarily or permanently and, if
30 permanently, may impanel another person in place of the grand
31 juror excused.
