SYNOPSIS AS INTRODUCED:
 
735 ILCS 5/2-1712.5 new
735 ILCS 5/2-1712.7 new

    Amends the Code of Civil Procedure. Creates the Medical Malpractice Task Force. Outlines the membership and duties of the Medical Malpractice Task Force. Provides that the Task Force shall submit a written report containing recommendations for uniform levels of compensation for particular injuries to the Governor and the General Assembly by June 30, 2005.

1     AN ACT concerning medical malpractice.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Code of Civil Procedure is amended by adding
5 Sections 2-1712.5 and 2-1712.7 as follows:
 
6     (735 ILCS 5/2-1712.5 new)
7     Sec. 2-1712.5. Medical Malpractice Task Force.
8     (a) There is hereby established the Medical Malpractice
9 Task Force.
10     (b) The Task Force shall consist of 17 voting members:
11         (1) Two members of the Senate, appointed one each by
12     the President of the Senate and the Minority Leader of the
13     Senate.
14         (2) Two members of the House of Representatives,
15     appointed one each by the Speaker of the House of
16     Representatives and the Minority Leader of the House of
17     Representatives.
18         (3) Four members representing malpractice insurers,
19     appointed one each by the President of the Senate, the
20     Minority Leader of the Senate, the Speaker of the House of
21     Representatives, and the Minority Leader of the House of
22     Representatives.
23         (4) Four members representing physicians and hospitals
24     in the State, appointed one each by the President of the
25     Senate, the Minority Leader of the Senate, the Speaker of
26     the House of Representatives, and the Minority Leader of
27     the House of Representatives.
28         (5) Four members who have academic research
29     backgrounds involving the economic aspects of tort law,
30     appointed one each by the President of the Senate, the
31     Minority Leader of the Senate, the Speaker of the House of
32     Representatives, and the Minority Leader of the House of

1     Representatives.
2         (6) One member representing the Illinois Trial Lawyers
3     Association.
4     (c) Members shall serve without compensation but may be
5 reimbursed for their expenses.
6     (d) If a vacancy occurs in the Task Force membership, the
7 vacancy shall be filled in the same manner as the initial
8 appointment.

10     Sec. 2-1712.7. Duties of the Task Force.
11     (a) The Task Force shall:
12         (1) gather information relating to the valuation of
13     injuries caused by medical malpractice;
14         (2) determine uniform levels of compensation for
15     particular types of injuries; and
16         (3) prepare a written report containing the
17     recommendations for uniform levels of compensation.
18     (b) The Task Force shall submit its report to the Governor
19 and the General Assembly by June 30, 2005.
