 1                     AMENDMENT TO SENATE BILL 46

 2        AMENDMENT NO.     .  Amend Senate Bill  46,  on  page  1,
 3    line  5,  by replacing "Section 3-10" with "Sections 3-10 and
 4    3-40"; and

 5    on page 4,  immediately  below  line  11,  by  inserting  the
 6    following:

 7        "(35 ILCS 105/3-40) (from Ch. 120, par. 439.3-40)
 8        Sec.  3-40.   Gasohol.   As  used  in this Act, "gasohol"
 9    means motor fuel that is no more than  90%  gasoline  and  at
10    least  10% denatured ethanol that contains no more than 1.25%
11    water by weight. The denatured ethanol used must be made from
12    corn produced solely in Illinois. Any  person  who  knowingly
13    sells or represents as gasohol any fuel that does not qualify
14    as gasohol under this Act is guilty of a business offense and
15    shall  be fined not more than $100 for each day that the sale
16    or representation takes place  after  notification  from  the
17    Department  of Agriculture that the fuel in question does not
18    qualify as gasohol.

20    on page 4, line  20,  after  the  period,  by  inserting  the
21    following:
22    "If  the  biomass material includes soybean oil, that soybean

 1    oil must be made from soybeans produced solely  in  Illinois.
 2    If  the  biomass  material  includes  denatured ethanol, that
 3    denatured ethanol must be made from corn produced  solely  in
 4    Illinois."; and

 5    on  page  4,  line  24,  after  the  period, by inserting the
 6    following:
 7    "The denatured ethanol used must be made from  corn  produced
 8    solely in Illinois.".
