 1                    AMENDMENT TO SENATE BILL 715

 2        AMENDMENT NO.     .  Amend Senate Bill 715  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The  Counties  Code  is amended by changing
 5    Section 3-5036 as follows:

 6        (55 ILCS 5/3-5036) (from Ch. 34, par. 3-5036)
 7        Sec. 3-5036.  Records open to  inspection.  All  records,
 8    indices,  abstract  and other books kept in the office of any
 9    recorder,  and  all  instruments  filed   therein   and   all
10    instruments  deposited or left for recordation therein shall,
11    during the office hours, be open for  public  inspection  and
12    examination;  and  all  persons  shall  have  free access for
13    inspection and examination to such  records,  indices,  books
14    and  instruments,  which  the  recorders  shall  be  bound to
15    exhibit to those who wish to inspect or examine the same; and
16    all persons shall  have  the  right  to  take  memoranda  and
17    abstracts  thereof  without  fee  or  reward. This Section is
18    subject to the provisions of "The Local Records Act".
19        Notwithstanding  any  provision  to  the  contrary,   any
20    certificate   of   discharge  or  release  from  active  duty
21    (including but not limited to the DD 214) or MEMBER-4 copy of
22    a certificate of discharge or release from active duty issued

 1    by the United States government or any state  government  and
 2    filed  with  the  county  clerk or recorder of deeds is not a
 3    public record and is not subject to public  inspection.  Upon
 4    request  of  the  veteran  whose  certificate of discharge or
 5    release from active duty (including but not limited to the DD
 6    214) or whose MEMBER-4 copy of certificate  of  discharge  or
 7    release from active duty has been filed with the county clerk
 8    or  recorder  of deeds or upon request of a person designated
 9    by the veteran as authorized to make the request, the  county
10    clerk  or  recorder  of deeds shall expunge the record of the
11    military discharge form from the record of the  county  clerk
12    or  recorder of deeds and replace the record with a form that
13    contains only the name of the veteran, the date of his or her
14    discharge from military service, and the date of the issuance
15    of the original military discharge form.
