AMENDMENT TO SENATE BILL 3014

2     AMENDMENT NO. ______. Amend Senate Bill 3014 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Unified Code of Corrections is amended by
5 adding Section 5-4-3a as follows:
 
6     (730 ILCS 5/5-4-3a new)
7     Sec. 5-4-3a. DNA testing backlog accountability.
8     (a) On or before February 1, 2005 and on or before February
9 1 of each year thereafter, the Department of State Police shall
10 report to the Governor and both houses of the General Assembly
11 the following information:
12         (1) the extent of the backlog of cases awaiting
13 biological testing or awaiting DNA analysis by that
14 Department, including but not limited to those tests
15 conducted under Section 5-4-3, as of December 31 of the
16 previous year. These cases shall include all criminal
17 sexual assault kits awaiting biological testing or DNA
18 analysis that are still in the custody or possession of the
19 police departments served by the State Police forensic
20 laboratories; and
21         (2) the number of felons eligible under Illinois law to
22 have their DNA profile submitted to the Federal Bureau of
23 Investigation Laboratory's Combined DNA Index System
24 (CODIS) who have not yet had their DNA entered into CODIS;

2         (3) what measures have been and are being taken to
3 reduce the backlogs reported in clauses (1) and (2) of this
4 subsection (a) and the estimated time frame and costs or
5 expenditures in doing so, as well as the source of funds
6 allotted for this purpose.
7     (b) The information reported under this Section shall be
8 made available to the public, at the time it is reported, on
9 the official web site of the Department of State Police.
 
10     Section 99. Effective date. This Act takes effect upon
11 becoming law.".
