| AN ACT concerning education.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Illinois Consortium for Educational | 5 |
| Opportunity Act is amended by changing the title of the Act and | 6 |
| Sections 1, 2, 3, 4, 6, 7, 8, 9, 10, and 11 and by adding | 7 |
| Section 11.5 as follows:

| Sec. 1. Short Title. This Act shall be known and may be | 13 |
| cited as the
Diversifying Faculty in Illinois
Illinois | 14 |
| Consortium for Educational Opportunity Act.

| Sec. 2. Definitions. As used in this Act, unless the | 18 |
| context otherwise requires:
| 19 |
| (a) "Board" means the Board of Higher Education.
| 20 |
| (b) "Institution of higher education" means a publicly or | 21 |
| privately
operated educational institution located within | 22 |
| Illinois: (1) which
offers instruction leading toward or | 23 |
| prerequisite to an academic or
professional degree beyond the | 24 |
| baccalaureate degree, excluding theological
schools, and (2) | 25 |
| which requires that in order to obtain such degree the
student | 26 |
| satisfactorily completes appropriate courses of class, | 27 |
| laboratory
or research study in residence under a faculty whose | 28 |
| members hold
appropriate academic degrees, and (3) which meets | 29 |
| the standards of
approval established by the Board of Higher | 30 |
| Education.

| (c) "Consortium Board" means the representatives of the | 2 |
| institutions of
higher education participating in the | 3 |
| Consortium established under this Act.
| 4 |
| "DFI"
(d) "ICEOP" means the Diversifying Faculty in | 5 |
| Illinois Program
Illinois Consortium for Educational | 6 |
| Opportunity
program of financial assistance to minorities who | 7 |
| are traditionally
underrepresented as participants in | 8 |
| postsecondary education. The program
shall assist them in | 9 |
| pursuing a graduate or professional degree and shall also | 10 |
| assist program graduates to find employment at an Illinois | 11 |
| institution of higher education, including a community | 12 |
| college, in a faculty or staff position .
| 13 |
| "Program Board" means the entity created to administer the | 14 |
| grant program authorized by this Act.
| 15 |
| "Qualified institution of higher education" means a | 16 |
| qualifying publicly or privately
operated educational | 17 |
| institution located within Illinois (i) that
offers | 18 |
| instruction leading toward or prerequisite to an academic or
| 19 |
| professional degree beyond the baccalaureate degree, excluding | 20 |
| theological
schools, and (ii) that is authorized to operate in | 21 |
| the State of Illinois.
| 22 |
| (e) "Racial minority" means a person who is a citizen of | 23 |
| the United
States or a lawful permanent resident alien of the | 24 |
| United States and who is:
| 25 |
| (1) Black (a person having origins in any of the black | 26 |
| racial groups in Africa);
| 27 |
| (2) Hispanic (a person of Spanish or Portuguese culture | 28 |
| with origins
in Mexico, South or Central America, or the | 29 |
| Caribbean Islands, regardless of race);
| 30 |
| (3) Asian American (a person having origins in any of | 31 |
| the original
peoples of the Far East, Southeast Asia, the | 32 |
| Indian Subcontinent or the
Pacific Islands); or
| 33 |
| (4) American Indian or Alaskan Native (a person having | 34 |
| origins in any
of the original peoples of North America).

| Sec. 3. Composition of the Program
Consortium Board. The | 3 |
| Program Board shall be comprised of 21 members and shall be | 4 |
| appointed by the Board of Higher Education. Persons appointed | 5 |
| to the Program Board shall include, but need not be limited to, | 6 |
| individuals who are in leadership positions in institutions of | 7 |
| higher education, including community colleges.
Consortium | 8 |
| Board shall include one representative from each of the
| 9 |
| institutions of higher education participating in the | 10 |
| Consortium.
| 11 |
| The method of selection shall be determined
by each | 12 |
| institution of higher education.
| 13 |
| The Board shall assure , by additional appointments to the | 14 |
| Consortium
Board, if necessary, that racial minorities who are | 15 |
| traditionally
underrepresented in postsecondary education | 16 |
| programs and activities are
members of the Program
Consortium
| 17 |
| Board.

| Sec. 4. Responsibilities of the Program
Consortium Board. | 21 |
| The Program
Consortium Board
shall be responsible for:
| 22 |
| (a) Establishing policy for administration of the DFI
| 23 |
| ICEOP grant program authorized under this Act, including | 24 |
| criteria to promote placement of grant recipients .
| 25 |
| (b) Reviewing and approving applications for | 26 |
| participation in the DFI
ICEOP grant program.
| 27 |
| (c) Establishing subcommittees or panels as necessary | 28 |
| to review applications and promote student placement. | 29 |
| (d) Reporting annually to the Board on program outcomes | 30 |
| and results, including lists of new and continuing | 31 |
| scholarship award recipients by institution, level, and | 32 |
| field of study; lists of recipients retained in the program | 33 |
| from the previous year; lists of placements of most recent | 34 |
| program graduates; a description of institutional efforts | 35 |
| to place program graduates; and a description of policy and |

| administrative actions designed to increase placement of | 2 |
| grant recipients.

| Sec. 6. DFI
ICEOP grants. A program of financial assistance | 6 |
| is
established to implement the policy of encouraging minority | 7 |
| students to
enroll and complete academic programs at the | 8 |
| postbaccalaureate level and to enhance the diversity of faculty | 9 |
| and staff of Illinois institutions of higher education . The
| 10 |
| Board of Higher Education shall provide administrative | 11 |
| assistance for the
Program
Consortium Board and shall | 12 |
| distribute funds appropriated by the General
Assembly for this | 13 |
| purpose in accordance with decisions made by the Program
| 14 |
| Consortium Board.

| Sec. 7. Eligibility for DFI
ICEOP grants. An individual is | 18 |
| eligible for an
award under the provisions of this Act when the | 19 |
| Program
Consortium Board finds:
| 20 |
| (a) That the individual is a resident of this State and | 21 |
| a citizen or
lawful permanent resident alien of the United | 22 |
| States;
| 23 |
| (b) That the individual is a member of a racial | 24 |
| minority as defined
under the terms of this Act;
| 25 |
| (c) That the individual has earned any educational | 26 |
| diploma at an
institution of education located in this | 27 |
| State, or is a resident of the
State for no less than three | 28 |
| years prior to applying for the grant, and the
individual | 29 |
| must hold a baccalaureate degree from an institution of | 30 |
| higher
learning;
| 31 |
| (d) That the individual's financial resources are such | 32 |
| that, in the
absence of a DFI
an
ICEOP grant, the | 33 |
| individual will be prevented from pursuing
a graduate or | 34 |
| professional degree at a qualified institution of higher
|

| education of his or her choice;
| 2 |
| (e) That the individual has above average academic | 3 |
| ability to pursue a
graduate or professional degree; and
| 4 |
| (f) That the individual meets other qualifications | 5 |
| which shall be
established by the Program
Consortium Board.
| 6 |
| Grant funds shall be awarded only to those persons pursuing | 7 |
| a graduate or professional degree program at a qualified | 8 |
| institution of higher education.
| 9 |
| The
Consortium Board shall by rule promulgate, pursuant to | 10 |
| the Illinois
Administrative Procedure Act, precise standards | 11 |
| to be used by the Program Board to
determine whether a program | 12 |
| applicant has above average academic ability to
pursue a | 13 |
| graduate or professional degree.

| Sec. 8. Application. The Program
Consortium Board shall | 17 |
| design the
application for the DFI
ICEOP award and determine | 18 |
| the timetable for submission
of the application.

| Sec. 9. Terms of award. After a person has been accepted | 22 |
| into
the DFI
ICEOP , the individual shall be eligible for an | 23 |
| annual award which may
shall be renewable for up to an | 24 |
| additional 3 years provided
that he or she makes satisfactory | 25 |
| progress toward completing his or her degree.
The Program
| 26 |
| Consortium Board shall determine the award amount annually.
| 27 |

| Sec. 10. Conditions of award. Conditions for acceptance of
| 30 |
| a DFI
an ICEOP award are that the recipient shall agree to: (1) | 31 |
| accept
a teaching or nonteaching full-time appointment at an | 32 |
| Illinois
institution of higher education; or (2) accept a | 33 |
| position at one
of the higher education governing boards for |

| the period equal to
the number of years that he or she was a | 2 |
| participant in the ICEOP;
or (3) accept a position as an | 3 |
| employee of this State in an
administrative, | 4 |
| educational-related
education related position for the period | 5 |
| equal to the number of
years that he or she was a participant | 6 |
| in the DFI

| Sec. 11. Penalty for failure to fulfill the conditions of a | 10 |
| DFI
an ICEOP
award. If the obligation of the award is not met, | 11 |
| repayment of the funds
awarded may be required according to | 12 |
| procedures
rules developed by the Program
Consortium Board.

| (110 ILCS 930/11.5 new) | 15 |
| Sec. 11.5. Continuing participants. Program participants | 16 |
| admitted under the provisions of the former Illinois Minority | 17 |
| Graduate Incentive Program/Illinois Consortium for Educational | 18 |
| Opportunity Program prior to January 1, 2004 shall be governed | 19 |
| by the statutory provisions and rules governing the program at | 20 |
| the time of their admission.

| Section 10. The Illinois Consortium for Educational | 23 |
| Opportunity Act is amended by repealing Section 5.
| 24 |
| Section 99. Effective date. This Act takes effect July 1, | 25 |
| 2004.
