SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Construction Site Temporary Restroom Facility Act. Provides that the owner of a temporary building or building under construction, not yet occupied for its intended purpose, shall insure that employees working on the construction site have access to restroom facilities located within 300 feet of the entrance of the building under construction and which meet several requirements. Provides that inspectors employed by municipalities and counties may inspect construction sites to insure compliance with the Act. Provides penalties for a violation of the Act. Effective immediately.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Construction Site Temporary Restroom Facility Act.
 
6     Section 5. Legislative finding. It has been established by
7 scientific evidence that improper plumbing can result in the
8 introduction of pathogenic organisms into the potable water
9 supply, result in the escape of toxic gases into the
10 environment, and result in potentially lethal disease and
11 epidemic. It is further found that minimum numbers of plumbing
12 facilities and fixtures are necessary for the comfort and
13 convenience of workers and persons in public places.
 
14     Section 10. Temporary restroom facility. The owner or the
15 owner's representative of a temporary building or building
16 under construction, that is not yet occupied for its intended
17 purpose, shall insure that employees working on the
18 construction site have access to restroom facilities which are
19 located within 300 feet of the entrance of the building under
20 construction and which meet the following requirements:
21         (1) Toileting facilities shall be enclosed and
22     discharged into a sanitary sewer. In lieu of connecting to
23     a sewer, the sanitary facility may be a portable, enclosed,
24     chemically-treated tank-tight unit.
25         (2) If individual portable units are used, separate
26     toileting facilities are not required for males and
27     females. Toileting facilities shall be provided as
28     follows:
29             (A) for fewer than 200 employees, one toilet
30         facility shall be provided for every 40 employees or
31         fraction thereof; and

1             (B) for more than 200 employees, one toilet
2         facility shall be added for every 50 employees or
3         fraction thereof.
4         (3) Hand cleansing units shall be provided.
5         (4) All non-sewered units shall be pumped and cleansed
6     regularly to ensure adequate working facilities.
 
7     Section 15. Enforcement. Inspectors employed by
8 municipalities and counties may inspect construction sites to
9 insure compliance with this Act.
 
10     Section 20. Penalty.
11     (a) Any owner who fails or refuses to comply with the
12 provisions of this Act shall be deemed guilty of a petty
13 offense.
14     (b) Any owner convicted of violating the provisions of this
15 Act shall be subject to a conviction for succeeding offenses
16 for each day he or she fails or refuses to comply with the
17 provisions of this Act.
 
18     Section 99. Effective date. This Act takes effect upon
19 becoming law.
