AMENDMENT TO SENATE BILL 821

2     AMENDMENT NO. ______. Amend Senate Bill 821 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Counties Code is amended by changing
5 Sections 3-1004, 3-2003.2, 3-4009, 3-5005.2, 3-9006, and
6 3-10005.1 as follows:
 
7     (55 ILCS 5/3-1004)  (from Ch. 34, par. 3-1004)
8     Sec. 3-1004. Internal operations of office. The county
9 auditor shall control the internal operations of the office and
10 procure equipment, materials and services necessary to perform
11 the duties of the office, subject to the budgetary limitations
12 established by the county board. Except in counties with
13 3,000,000 or more inhabitants, purchases of equipment of
14 $20,000 or more by the county auditor shall be made in
15 accordance with any ordinance requirements for centralized
16 purchasing through another county office or through the State
17 that are applicable to all county offices.

20     Sec. 3-2003.2. Internal operations of office. The county
21 clerk shall have the right to control the internal operations
22 of his office; to procure necessary equipment, materials and

1 counties with 3,000,000 or more inhabitants, purchases of
2 equipment of $20,000 or more by the county clerk shall be made
3 in accordance with any ordinance requirements for centralized
4 purchasing through another county office or through the State
5 that are applicable to all county offices.

8     Sec. 3-4009. Office quarters; expenses. The County Board
9 shall provide suitable office quarters for the use of the
10 Public Defender, and shall pay out of the county treasury for
11 necessary office, travel and other expenses incurred in the
12 defense of cases. Except in counties with 3,000,000 or more
13 inhabitants, purchases of equipment of $20,000 or more by the
14 public defender shall be made in accordance with any ordinance
15 requirements for centralized purchasing through another county
16 office or through the State that are applicable to all county
17 offices. In counties of less than 500,000 population, such
18 payment shall be made after the circuit court of the county
19 approves such expenses as being necessary and proper. In cases
20 where 2 or more adjoining counties have joined to form a common
21 office of Public Defender, the expenses incurred under this
22 Section shall be paid as provided for in a joint resolution of
23 the various county boards involved.

26     Sec. 3-5005.2. Internal operations of office. The recorder
27 shall have the right to control the internal operations of his
28 office; to procure necessary equipment, materials and services
29 to perform the duties of his office. The Recorder shall have
30 the right to select the computer or micrographic system to be
31 used for document storage and retrieval. The Recorder may
32 retain the services of management or consulting firms to

1 establish or maintain such a system. Except in counties with
2 3,000,000 or more inhabitants, purchases of equipment of
3 $20,000 or more by the recorder shall be made in accordance
4 with any ordinance requirements for centralized purchasing
5 through another county office or through the State that are
6 applicable to all county offices.

9     Sec. 3-9006. Internal operations of office. The State's
10 attorney shall control the internal operations of his office
11 and procure the necessary equipment, materials and services to
12 perform the duties of his office. Except in counties with
13 3,000,000 or more inhabitants, purchases of equipment of
14 $20,000 or more by the State's attorney shall be made in
15 accordance with any ordinance requirements for centralized
16 purchasing through another county office or through the State
17 that are applicable to all county offices.

20     Sec. 3-10005.1. Internal operations of office. The
21 treasurer shall control the internal operations of his office
22 and procure necessary equipment, materials and services to
23 perform the duties of his office. Except in counties with
24 3,000,000 or more inhabitants, purchases of equipment of
25 $20,000 or more by the treasurer shall be made in accordance
26 with any ordinance requirements for centralized purchasing
27 through another county office or through the State that are
28 applicable to all county offices.

30     Section 99. Effective date. This Act takes effect January
31 1, 2006.".
