1     AN ACT concerning government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Jobs
5 for Guns Act.
 
6     Section 5. Definitions. For the purposes of this Act:
7     "Gun" means firearm and has the meanings ascribed to it in
8 Section 1.1 of the Firearm Owners Identification Card Act.
9     "Gun buy back program" means any gun trade-in program
10 authorized, sanctioned, or sponsored by any State or local
11 government entity or not-for-profit organization.
12     "List" means a list of the names and contact information
13 voluntarily provided by participants in a gun buy back program.
 
14     Section 15. Operation; Jobs for Guns Fund.
15     (a) The Jobs for Guns Fund is created as a special fund in
16 the State treasury. The Department of State Police shall make
17 grants from funds appropriated from the Jobs for Guns Fund. The
18 grants may be awarded to and used by State and local
19 governmental entities and not-for-profit organizations for the
20 following purposes:
21         (1) to pay $100 per gun to each participant in a gun
22     buy back program who turns in a minimum of 2 guns;

1         (2) to keep records of the name and contact information
2     of each individual who, of his or her own volition, turns
3     in 2 guns to a gun buy back program and records his or her
4     information on the program's list; and
5         (3) to distribute a program's list to any and all
6     companies, contractors, organizations, or vendors, that as
7     a matter of public record have received funds from the
8     federal American Recovery and Reinvestment Act or the
9     "Illinois Jobs Now! Program" for the purposes of
10     infrastructure construction, as a list of potential
11     employees.
12     (b) The list compiled by any grantee shall not, under any
13 circumstances, be distributed or reproduced in any form or
14 fashion to any law enforcement agency; to any law enforcement
15 representative or official; to any criminal investigatory
16 entity; or to any individual not associated with the gun buy
17 back program. The Department of State Police shall not make any
18 copies or reproductions of the list for any criminal
19 investigation purposes.
20     (c) Grants under this Act shall not be available at any
21 time that the Fund does not have moneys currently available to
22 compensate a gun trade-in.
23     (d) Persons participating in the gun buy back program shall
24 not be prosecuted under Section 24-1, Section 24-1.1, or
25 Section 24-1.7 of the Criminal Code of 1961 and Section 2 of
26 the Firearm Owners Identification Card Act.

1     (e) Persons participating in the gun buy back program who
2 voluntarily put their contact information on the list are still
3 required to undergo any and all job application processes that
4 are obligatory for members of the general public.
 
5     Section 20. Transfer. Notwithstanding any other provision
6 of State law to the contrary and in addition to any other
7 transfers that may be provided for by law, on the effective
8 date of this Act, or as soon as may be practical thereafter,
9 the State Comptroller shall direct the transfer of, and the
10 State Treasurer shall transfer, $1,000,000 from the General
11 Revenue Fund into the Jobs for Guns Fund.
 
12     Section 95. The State Finance Act is amended by adding
13 Section 5.719 as follows:
 
14     (30 ILCS 105/5.719 new)
15     Sec. 5.719. Jobs for Guns Fund.
 
16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
